Այսօր կայացած Երևանի ավագանու նիստում փոխքաղաքապետեր են ընտրվել/նշանակվել: Նրանք իրենց լիազորությունները ստանձնելու են ապօրինաբար:
 
Բանն այն է, որ հայտնի հանգամանքներում Երևանի քաղաքապետ դարձած Տիգրան Ավինյանն իր պաշտոնը ստանձնել է օրենքի խախտումով, քանզի երդման արարողության ժամանակ չի ապահովվել ավագանու անդամների՝ օրենքով պահանջվող քվորումը: Այսինքն՝ Երևանի քաղաքապետի պաշտոնը Ավինյանը ստանձնել է ապօրինաբար:
 
Այսպիսով, Տ. Ավինյանը այսօր իրավական որևէ հիմք չուներ մայրաքաղաքի փոխքաղաքապետեր առաջադրելու:
 
Սա նշանակում է, որ ինչպես որ Տ. Ավինյանը չի հանդիսանում Երևանի օրինական քաղաքապետ, այնպես էլ օրենքից դուրս են նրա առաջարկով Երևանի փոխքաղաքապետերի պաշտոններում հաստատվածները։
