ԼՂ-ից բռնի տեղահանվածներին կտրվի փախստականի կարգավիճակ. Թոշակ ստանալու համար պետք է ՀՀ քաղաքացի դառնան

Կառավարությունն իր այսօրվա՝ հոկտեմբերի 26-ի նիստում հաստատեց Լեռնային Ղարաբաղից բռնի տեղահանված անձանց ժամանակավոր պաշտպանության տակ վերցնելու, ժամանակավոր պաշտպանություն ստացած փախստականի անձը հաստատող փաստաթղթի նկարագիրը և դրա տրամադրման կարգը:

Արդարադատության նախարար Գրիգոր Մինասյանը՝ ներկայացնելով նախագիծը՝ նշեց, որ Կառավարության որոշմամբ ժամանակավոր պաշտպանության տակ կվերցվեն հետևյալ անձինք. ԼՂ-ի բնակչության ռեգիստրի հաշվառումներով անցնող անձինք, ՀՀ տարածքում կամ ՀՀ-ից դուրս գտնվող այն անձինք, որոնց վերջին հաշվառման հասցեն եղել է ԼՂ-ն, և 3-րդ խումբն այն անձինք են, որոնք չեն ունեցել հաշվառում ԼՂ-ի բնակչության ռեգիստրում, սակայն բնակվել են ԼՂ-ում և 2023 թվականի սեպտեմբերի 19-ից հետո հաշվառվել են ՀՀ Միգրացիայի և քաղաքացիության ծառայության կողմից։

«ԼՂ-ում տեղի ունեցած իրադաձությունների, այդ թվում՝ Լաչինի միջանցքի ապօրինի արգելափակման, 2023-ի սեպտեմբերի 19-ի Ադրբեջանի ռազմական ագրեսիայի հետևանքով ԼՂ-ի ողջ բնակչությունն իրենց կամքին հակառակ բռնի տեղահանվել են իրենց մշտական բնակության երկրից՝ հայտնվելով ՀՀ տարածքում, և նրանք տեղահանվել են համատարած բռնության և բռնության իրական սպառնալիքի, մարդու իրավունքների զանգվածային խախտումների, հասարակական կարգը խախտող իրադարձությունների և Ադրբեջանի հայատյաց, ԼՂ-ի ժողովրդին էթնիկ զտման ենթարկելու քաղաքականության պատճառով։

Փաստացի, ԼՂ-ի բնակիչները այսօր հնարավորություն չունեն վերադառնալու իրենց մշտական բնակության երկիր։ Նախագծի ընդունման արդյունքում կհստակեցվի ԼՂ-ից բռնի տեղահանված անձանց իրավական կարգավիճակը և դրանով՝ նաև նրանց իրավունքների և պարտականությունների շրջանակը»,-ասաց նախարարը:

Գրիգոր Մինասյանն ընդգծեց, որ ժամանակավոր պաշտպանության տակ վերցված անձինք օրենքի ուժով դառնում են փախստական և օգտվում են փախստականների համար օրենքով և միջազգային կոնվենցիաներով, այդ թվում՝ փախստականների կարգավիճակի մասին 1951 թվականի կոնվենցիայով նախատեսված իրավունքներից։

«Նախագծի ընդունումը հնարավորություն կտա ձեռնամուխ լինել նրանց իրավունքների և օրինական շահերի առավել արդյունավետ պաշտպանությանը»,- հայտարարեց նա:

Նա նաեւ հավելեց, որ այս որոշումն ուժի մեջ մտնելուց հետո բոլոր բռնագաղթածներն ինքնաշխատ եղանակով կդառնանա փախստական և երեք ամսվա ընթացքում կարող են փախստականի փաստաթուղթը վերցնել համապատասխան գերատեսչություններից, ինչը նրանց անհրաժեշտ է  ճամփորդելու դեպքում:

ԱԳ նախարար Արարատ Միրզոյանն ընդգծեց, որ մարդիկ առանց որևէ դիմումի և որևէ մարմին այցելելու ստանում են  ժամանակավոր պաշտպանության տակ գտնվող անձի կարգավիճակը, ըստ էության, փախստականի կարգավիճակը, և իրենք դիմումով կամ այդ փաստաթուղթը ստանալու բերումով չէ, որ ձեռք են բերելու այդ կարգավիճակը։ Դա ուղղակի լինելու է կարգավիճակը հաստատող փաստաթուղթ, որը երբեմն, դիցուք, ճամփորդելիս կարող է անհրաժեշտ լինել:

Միրզոյանը նաև նշեց, որ մարդիկ, այդ կարգավիճակն ունենալով, իրավունք ունեն դիմելու և ստանալու ՀՀ քաղաքացիություն՝ դրանից բխող բոլոր հավելյալ իրավունքներով և պարտականություններով, այդ թվում՝ կենսաթոշակ ստանալու, բայց նաև, օրինակ, քաղաքացի դառնալով, կենսաթոշակ ստանալով՝ փախստականին տրամադրվող սոցիալական աջակցությունը տեղին չի լինի։
