Պաշտպանության նախկին նախարար Վիգեն Սարգսյանի նկատմամբ հեռակա քրեական վարույթ է հարուցվել

Դատախազը 2023 թվականի հոկտեմբերի 24-ին հանրային նոր քրեական հետապնդում է հարուցել ՀՀ պաշտպանության նախկին նախարար Վ.Ս.-ի նկատմամբ այն բանի համար, որ նա Նախարարության հաշվեկշռում գտնվող՝ Երևան քաղաքի Հասրաթյան փողոցի բազմաբնակարան շենքի բնակարանների բաշխման գործընթացում 2018 թվականի հունվարին դիտավորությամբ կատարել է իր լիազորությունների շրջանակից ակնհայտորեն դուրս գտնվող գործողություններ: Արդյունքում՝ էական վնաս է պատճառվել անձանց իրավունքներին, օրինական շահերին, ինչպես նաև պետության օրինական շահերին, ինչն անզգուշությամբ առաջացրել է ծանր հետևանքներ:
Մասնավորապես՝ Պաշտպանության նախարարության հաշվեկշռում ընդգրկված շենքից բնակարանային պայմանների բարելավման կարիք ունեցող զինծառայողներին անհատույց օգտագործման իրավունքով 71 բնակարան հատկացնելու նպատակով 2018 թվականի հունվարի 18-ին հրավիրված նիստին ընդառաջ, անտեսելով Կառավարության որոշմամբ հաստատված կարգի պահանջները, Նախարարության կենտրոնական բնակարանային հանձնաժողովի անդամներին Վ.Ս.-ն հանձնարարել է առաջիկա նիստում բնակարաններ հատկացնել բնակարանային հաշվառման մեջ չգտնվող կամ ցուցակներում ավելի ուշ ընդգրկված՝ իր կողմից նախընտրած 26 զինծառայողների, ինչպես նաև Նախարարության համակարգի՝ զինծառայող չհանդիսացող երեք անձանց:
Հանձնարարությունը հիմք ընդունելով՝ Հանձնաժողովը կայացրել է ապօրինի որոշում. արդյունքում՝ նշված շենքից անհատույց օգտագործման իրավունքով բնակարաններ են հատկացվել Երևան քաղաքում բնակարանային ապահովման կարիք ունեցող զինծառայողների հաշվառման ցուցակներում ավելի ուշ ընդգրկված ու բնակարանային հաշվառման մեջ չգտնվող զինծառայողների և Պաշտպանության նախարարության համակարգի՝ զինծառայող չհանդիսացող անձանց:
2023 թվականի հոկտեմբերի 25-ին որոշում է կայացվել մեղադրյալ Վ.Ս.-ի նկատմամբ իրականացնել հեռակա վարույթ: Նույն օրը հեռակա վարույթով մեղադրանքը ներկայացվել է Վ.Ս.-ի պաշտպանին:
Հիշեցնենք, որ նախաքննության ընթացքում մեղադրյալ Վ.Ս.-ի նկատմամբ որպես խափանման միջոց է կիրառվել կալանավորումը՝ 2 ամիս ժամկետով. նրա նկատմամբ հայտարարվել է հետախուզում:
Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ Քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
