2023 թվականի հունիսի 22-ին Պետական եկամուտների կոմիտեից հաղորդում է ստացվել Քննչական կոմիտե՝ անհատ ձեռնարկատեր Ա.Մ.-ի կողմից առանձնապես խոշոր չափերով հարկ չվճարելու վերաբերյալ։
2023 թվականի հունիսի 23-ին վարույթն իրականացնող մարմինը, արձաագրելով, որ հաղորդումը չի պարունակում առերևույթ հանցանքի մասին տեղեկություններ, քրեական վարույթ չի նախաձեռնել, ինչի մասին գրավոր տեղեկացրել է հսկող դատախազին:
2023 թվականի հունիսի 26-ին դատախազը չի հաստատել քննիչի կողմից վարույթ չնախաձեռնելու օրինականությունը և հանձնարարել՝ Քրեական օրենսգրքի 290-րդ հոդվածի 3-րդ մասի 2-րդ կետով (hարկերը, տուրքերը կամ այլ վճարներ չվճարելը) նախաձեռնել քրեական վարույթ, իրականացնել նախաքննություն:
Դատախազի հանձնարարության արդյունքում նախաձեռնված քրեական վարույթի շրջանակում հիմնավորվել է, որ Ա.Մ.-ն, լինելով անհատ ձեռնարկատեր, առանձնապես խոշոր չափերի հարկերը չվճարելու նպատակով՝ 2020-2023 թվականների ընթացքում հաշվարկների մեջ ներառել է խեղաթյուրված տվյալներ, ինչի արդյունքում պետությանը պատճառվել է 513 մլն 917 հազար 628 դրամի վնաս:
Նախաքննության ընթացքում Ա.Մ.-ն ամբողջությամբ վերականգնել է պետությանը պատճառված վնասը և չի առարկել, որպեսզի իր նկատմամբ քրեական հետապնդում չհարուցվի Քրեական դատավարության օրենսգրքի 12-րդ հոդվածի 1-ին մասի 12-րդ կետով նախատեսված (ոչ արդարացնող) հիմքով:
2023 թվականի հոկտեմբերի 13-ին դատախազը Ա.Մ.-ի նկատմամբ հանրային քրեական հետապնդում չհարուցելու մասին որոշում է կայացրել՝ ոչ արդարացնող հիմքով:
