Լևոն Քոչարյանի գործով քննչական մարմնի անգործողությունը նույնիսկ արձանագրվել է դատախազության կողմից․ «Փաստ»

«Փաստ» օրաթերթը գրում է.
«Փաստ» թերթին նոր տեղեկություններ են հայտնի դարձել Լևոն Քոչարյանի գործի վերաբերյալ: Հիշեցնենք, որ Լևոն Քոչարյանը սեպտեմբերի 22-ից միջին մարմնական վնասվածք ստանալու, ուղեղի ցնցում ստանալու պայմաններում ձերբակալված է, սեպտեմբերի 25-ից՝ կալանավորված, և գտնվում է Նուբարաշեն քրեակատարողական հիմնարկում, իսկ դեպքի մասնակից ոստիկաններից որևէ մեկի նույնիսկ լիազորությունները չեն կասեցվել, առավել ևս՝ որևէ մեկը ձերբակալված կամ կալանավորված չէ: Փաստաբանների բազմաթիվ բողոքների, Մարդու իրավունքների պաշտպանի աշխատակազմի փաստերի արձանագրման պայմաններում, Լևոն Քոչարյանն, ի վերջո, ստացել է տուժողի դատավարական կարգավիճակ՝ խոշտանգման դեպքով:
Ստացվում է՝ միջադեպի մասնակից չորս ոստիկանները գիտակցում են, որ իրենք փաստացի քրեական հետապնդման ենթակա անձինք են և նման պայմաններում են տալիս ցուցմունքներ, այլ կերպ ասած՝ ունեն ուղիղ կաշկանդվածություն և անաչառ լինել չեն կարող: Քննչական կոմիտեն ստեղծված իրավիճակում որոշել է ոչ թե, ի վերջո, քրեական հետապնդում հարուցել չորս ոստիկանների նկատմամբ, այլ Լևոն Քոչարյանի կալանքի ժամկետը երկարաձգելու միջնորդությամբ հանդես գալ: Այստեղ ևս իրավիճակը խճճվել է, քննչական մարմինը փաստացի միջնորդում է երկարաձգել մի կալանք, որի գոյության հարցը լուծելու է վերաքննիչ քրեական դատարանը հոկտեմբերի 19-ին, հետևաբար առանց այդ որոշման հնարավոր չէ լուծել երկարաձգման միջնորդությունը, բայց մյուս կողմից՝ երկարաձգման միջնորդությունը կարող է ներկայացվել մինչև հոկտեմբերի 17-ը:
Պատահական չէ, որ հենց այս գործով համակարգից և գործից հրաժարվել են մի քանի քննիչներ, ինչի մասին առիթ ունեցել են տեղեկացնել: Մյուս կողմից՝ նույն քննչական մարմինը, որը 48 ժամում կարողացել էր թվով 10-ից ավելի վարույթային գործողություն անել, Լևոն Քոչարյանի կալանավորված լինելու ընթացքում, այսինքն՝ սեպտեմբերի 25-ից մինչ օրս 3 կամ 4 գործողություն է կատարել, այն պարագայում, որ տրամաբանությունը պետք է լիներ հակառակը՝ կալանքի պայմաններում քննչական մարմինը պետք է գործի չափազանց արագ և սեղմ ժամկետներում, հակառակ դեպքում կալանքը վերածվում է զուտ պատժիչ գործողության: Հատկանշական է, որ քննչական մարմնի անգործողությունը նույնիսկ արձանագրվել է դատախազության կողմից: Թերթը հետևելու է իրադարձությունների զարգացմանը, որին կանդրադառնանք առաջիկայում:
