Վիտալի Բալասանյանի նկատմամբ քրեական հետապնդումը դադարեցվել է, գործը կարճվել՝ հանցակազմի բացակայության հիմքով

Արցախի հերոս, Արցախի ԱԽ նախկին քարտուղար Վիտալի Բալասանյանի դեմ հարուցված քրեական գործը կարճվել է՝ հանցակազմի բացակայության հիմքով, «Փաստինֆո»-ին հայտնել է նրա փաստաբան Ռաֆայել Մարտիրոսյանը։
«Մեզ համար ցանկալի կլիներ, որ գործի վարույթը շարունակվեր և դատական քննության ընթացք ունենար, որովհետև գտնում ենք, որ հարուցված քրեական գործը և առաջադրված մեղադրանքը հիմնավոր չեն եղել, և Վիտալի Բալասանյանն անկասկած կարդարացվեր Արցախի Հանրապետության դատարանների կողմից։ Այդուհանդերձ, վարույթն իրականացնող մարմինը որոշում է կայացրել քրեական հետապնդումը դադարեցնելու և վարույթը կարճելու մասին»,- նշել է փաստաբանը՝ հավելելով, որ հասկանալի պատճառներով՝ չեն ստացել որոշումը, սակայն գործը փաստացի կարճված է, պաշտպանության կողմին հասած տեղեկությունների համաձայն՝ գործը կարճվել է հանցակազմի բացակայության հիմքով։
Ինչպես հայտնի է՝ մինչև Ադրբեջանի ցեղասպանական գործողությունների հետևանքով Արցախի փաստացի հայաթափումը՝ Արցախում տիրող լարված իրավիճակի պայմաններում հուլիսի 13-ին ԱԱԾ-ն իր իսկ տանից ձերբակալել էր Վիտալի Բալասանյանին, նրա որդուն, եղբորը, քեռորդուն։ Մինչ Բալասանյանի ձերբակալության վերաբերյալ պաշտոնական գերատեսչությունը հաղորդագրություն կատարածեր՝ մամուլում շրջանառության մեջ դրվեցին մտացածին տեղեկություններ՝ նրան կոռուպցիոն բնույթի չարաշահումների մեջ մեղադրելով, մինչդեռ, պարզվեց, որ Վիտալի Բալասանյանի ձերբակալությունը որևէ առնչություն չունի պաշտոնեական պարտականությունների կատարման հետ։ Քրեական գործը, որի շրջանակներում խուզարկություն էր իրականացվել, վերաբերում է Բալասանյանի որդու կողմից վարկն իբրև ոչ նպատակային օգտագործելու հետ։ Այս գործով Վիտալի Բալասանյանի որդին կարգավիճակ չունի, իսկ Վիտալի Բալասանյանն էլ ձերբակալվել էր խուզարկության ժամանակ, իբր, իշխանության ներկայացուցչի նկատմամբ բռնության սպառնալիքի կասկածանքով։ Նրանից բացի իրավապահները բերման էին ենթարկել նաեւ նրա որդուն՝ Արթուր Բալասանյանին, եղբորը՝ Վաչիկ Բալասանյանին, քեռորդին՝ Գարիկ Յուզբաշյանին, որոնք հարցաքննվել և ազատ են արձակվել։ Ավելի ուշ հայտնի դարձավ, որ Վիտալի Բալասանյանին մեղադրանք է առաջադրվել Արցախի քրեական օրենսգրքի չորս հոդվածով՝ գույքի հափշտակության, ապօրինի կերպով զենք, ռազմամթերք պահելու, իշխանության ներկայացուցչի նկատմամբ կյանքի կամ առողջության համար ոչ վտանգավոր բռնություն գործադրելու, թմրամիջոցներ պահելու համար։
Այժմ, փաստացի, Բալասանյանի նկատմամբ քրեական հետապնդումը դադարեցված է։ Փաստաբանը կարծում է, որ Վիտալի Բալասանյանի որդու վերաբերյալ գործը ևս պետք է, որ կարճված լինի, սակայն տեղեկություն փաստաբանը չունի, վերջին իրադարձություններով պայմանավորված՝ քննիչի հետ կապ հաստատել ևս չի հաջողվում։
ՀՀ տեղափոխվելուց հետո Վիտալի Բալասանյանը հարցաքննվել է նաև ԱԱԾ-ում՝ վկայի կարգավիճակով։ Փաստաբանը չի մանրամասնել, թե ինչ քրեական վարույթի շրջանակներում է Բալասանյանը հարցաքննվել, միայն արձանագրել է, որ նրա կարգավիճակն այնպիսին է, որ մտավախություն չի առաջացնում։
