ՄԻԵԴ-ն ընդդեմ Թուրքիայի որոշում է կայացրել

Մարդու իրավունքների եվրոպական դատարանը (ՄԻԵԴ) «ByLock» հավելվածի (այն ապահովում է կապ-հասանելիություն փակ-կոդավորված տարածքում) և Ասիական բանկի գործով ընդդեմ Թուրքիայի որոշում է կայացրել: Այս մասին տեղեկացնում է ermenihaber.am-ը։
ՄԻԵԴ-ը հանցանք չի համարել 2016-ի հուլիսի 15-ին Թուրքիայում հեղափոխության փորձից հետո «ByLock» հավելվածի օգտագործումն ու Ասիական բանկում գումարային ներդրումներ կատարելը, որոնք հազարավոր մարդկանց ձերբակալման և կամ պաշտոնանկ անելու պատճառ են դարձել Թուրքիայում:
Այլ հակառակը, վճռել է, որ Թուրքիան խախտել է մարդու իրավունքները՝ օրինակ գաղտնի վկայի ցուցմունքի հիման վրա դատապարտելով թուրք ուսուցիչ Յուքսել Յալչընկայային՝ հավելվածն օգտագոծելու և Ասիական բանկում հաշիվ ունենալու համար:
ՄԻԵԴ-ի նման որոշման համար հիմք է հանդիսացել այն, որ Թուրքիան խախտել է Եվրոպայի մարդու իրավունքների կոնվենցիայի «անօրինական դատավճիռ չի կարող լինել» ենթադրող 7-րդ կետը, կազմակերպվելու ու հավաքվելու մասին 11-րդ կետը և արդար դատաքննության իրավունքնի հետ կապված 6-րդ կետը:
ՄԻԵԴ-ի Մեծ պալատը 7-րդ կետի խախտման վերաբերյալ որոշումը կայացրել է ձայների մեծամասնությամբ՝ 11 կողմ, 6 դեմ, 6-րդ հոդվածի առաջին պարբերության խախտման վերաբերյալ որոշումը՝ 11 կողմ, 1 դեմ ձայների մեծամասնությամբ, իսկ միաձայն՝ 11-րդ հոդվածի խախտման վերաբերյալ։
Որոշման համաձայն՝ Թուրքիան պարտավորվում է նաև հայցատուին (այս դեպքում՝ մարդը, ով տուժել է և դիմել է դատարան) վճարել 15.000 եվրո՝ դատարանի ծախսերը հոգալու համար:
Նշենք, որ ՄԻԵԴ-ի տարածած հայտարարության մեջ նշվել է նաև, որ Թուրքական իշխանությունների հաղորդմամբ՝ «ByLock»-ի օգտատերերի թիվը հասնում է 100.000-ի:
Բացի այդ կա հիշեցում, ըստ որի՝ 6-րդ և 7-րդ կետի հիման վրա Թուրքիայի դեմ թվով 8.500 բողոք կա:
