«Փաստ» օրաթերթը գրում է.

Շրջակա միջավայրի նախարարությունն առաջարկում է լրացում կատարել «Վարչական իրավախախտումների վերաբերյալ» օրենսգրքում: Նախագծի ընդունմամբ ակնկալվում է, որ կկանխվի ապօրինի աղբավայրերի շահագործումը, աղբի տեղադրման վայրը տնօրինողները կամ համայնքի ղեկավարը հետևողական կլինեն աղբավայրերի պատշաճ շահագործման, աղբավայրի վնասակար ազդեցության մշտադիտարկման, լիազոր մարմիններին մշտադիտարկման տվյալների ներկայացման հարցում, իսկ ստացված տվյալների հիման վրա իրականացվող միջոցառումների շնորհիվ կնվազեցվի շրջակա միջավայրի վրա աղբավայրի վնասակար ազդեցությունը։ Նախ օրենսդրական նախաձեռնությունների մասին:

Տարածքային զարգացման և շրջակա միջավայրի նախարարական կոմիտեի 2023 թ.-ի օգոստոսի 14-ի նիստում Շրջակա միջավայրի նախարարության մշակած «Աղբավայրերի մոնիթորինգի իրականացման կարգը սահմանելու մասին» նախագծի քննարկման արդյունքում որոշվել էր այն կոմիտեի օրակարգից հանել՝ նախարարությանն առաջարկելով զուգահեռ Տարածքային կառավարման և ենթակառուցվածքների նախարարության հետ համատեղ մշակել ապօրինի աղբավայրերի մասով տուգանքների խստացման վերաբերյալ նախագիծ: Մասնավորաբար, տուգանքը նախատեսելով ոչ թե իրավախախտում կատարողի, այլ հողի սեփականատիրոջ նկատմամբ: Այնուհետև ԱԺ-ում 2023 թ.-ի ապրիլի 13-ին ընդունվեց ՏԿԵՆ-ի մշակած «Աղբահանության և սանիտարական մաքրման մասին օրենքում փոփոխություններ և լրացումներ կատարելու մասին» նախագիծը։ Նույն օրն ընդունվեց նաև «Վարչական իրավախախտումների վերաբերյալ» օրենսգրքում լրացումներ կատարելու նպատակով ոստիկանության հետ համատեղ մշակված օրինագիծը։ Ի դեպ, հաջորդ տարվա հունվարի 1-ից ուժի մեջ կմտնի օրենսգրքի այն հոդվածը, որի համաձայն՝ աղբավայրը շահագործողների կողմից աղբավայրերի մոնիթորինգի իրականացման կարգը խախտելու համար նախատեսում է վարչական տուգանքի կիրառում:

Այսպիսով՝ մի շարք համայնքներում աղբի տեղադրման համար պատասխանատու կազմակերպություններ չկան, իսկ աղբի հավաքումն ու աղբավայր տեղափոխումն ապահովվում է համայնքի ղեկավարի կամ անմիջապես համայնքի բնակիչների, համայնքի տարածքում տնտեսական գործունեություն իրականացնողների կողմից: Ուստի աղբավայրի շահագործման համար պատասխանատուների բացակայության դեպքում, ինչպես նաև աղբավայրի շահագործումը դադարեցնելուց, փակելուց հետո օրենսդրությամբ սահմանված կարգով աղբավայրի վնասակար ազդեցության մոնիթորինգ չիրականացնելու, դրա տվյալները լիազոր մարմնին չներկայացնելու դեպքում առաջարկվում է վարչական պատասխանատվության միջոց սահմանել աղբի տեղադրման վայրը սեփականության կամ վարձակալության իրավունքով տնօրինողի կամ համայնքի ղեկավարի նկատմամբ, եթե որպես աղբավայր օգտագործվող տարածքը համայնքային սեփականության տարածք է։
