Վրաստանում գրանցված տրանսպորտային միջոցը ՀՀ ժամանակավորապես ներմուծելու համար ՀՀ քաղաքացին հատուկ դեպոզիտային հաշվին գումար կվճարի. «Փաստ»

«Փաստ» օրաթերթը գրում է

ՊԵԿ-ն օրերս հանրային քննարկման է ներկայացրել «Ժամանակավորապես ՀՀ ներմուծվող անձնական օգտագործման տրանսպորտային միջոցների համար մաքսատուրքերի և հարկերի վճարման պարտավորությունների ապահովման որոշակի միջոց սահմանելու մասին» նախագիծը: Նշվում է, որ Վրաստանում ավտոմեքենաների մաքսազերծման համար օրենքով սահմանված վճարների չափերն անհամեմատ ցածր են ԵԱՏՄ օրենսդրությամբ նախատեսված վճարների չափերից: Այդ պատճառով ՀՀ-ում ավտոմեքենաները օրենքով սահմանված կարգով մաքսազերծելու և գրանցելու փոխարեն ավտոմեքենաները մաքսազերծվում և գրանցվում են Վրաստանում, ներմուծվում ու տնօրինվում են ՀՀ-ում ձևական՝ «ժամանակավոր ներմուծում» ձևակերպելու ճանապարհով:

ՊԵԿ-ը տեղեկացնում է, որ ներկայումս մեր երկրի տարածքում այս կարգավիճակով շահագործվում է մոտ 10000 միավոր ավտոմեքենա: Արդյունքում վճարումներ չեն կատարվում պետբյուջե թե՛ մաքսատուրքերի, թե՛ ավելացված արժեքի հարկի, թե՛ գույքահարկի գծով: Դրա փոխարեն ՀՀ-ում շահագործվող ավտոմեքենաների համար նշված գումարները վճարվում են հարևան երկրի պետբյուջե: Հաշվի առնելով սա, առաջարկվում է, որ ԵԱՏՄ ֆիզիկական անձանց կողմից օտարերկրյա պետություններում հաշվառված անձնական օգտագործման տրանսպորտային միջոցների ժամանակավոր ներմուծման դեպքում կի րառ վի ԵԱՏՄ մաքս այ ի ն օրենսգրքի 63-րդ հոդվածի 1-ին մասի 1-ին կետով նախատեսված վճարման ապահովման ձևը՝ դրամական միջոցներով վճարման պարտավորության կատարման ապահովումը։

Այս պարագայում ԵԱՏՄ ֆիզիկական անձինք (ՀՀ քաղաքացիները, այդ թվում՝ երկքաղաքացիները) Վրաստանում գրանցված տրանսպորտային միջոցը ՀՀ ժամանակավորապես ներմուծելու համար ստիպված կլինեն այդ մեքենան ազատ շրջանառության համար բացթողնելու համար վճարման ենթակա մաքսատուրքի և հարկերի չափով գումար վճարել հատուկ դեպոզիտային հաշվին, որը նրանց կվերադարձվի տվյալ ավտոմեքենան վերաարտահանելիս։ Առաջարկվող սահմանափակումը չի տարածվի ԵԱՏՄ մաքսային օրենսգրքի 264-րդ հոդվածի 1-ին մասի 1-ին պարբերությունում հիշատակված օտարերկրյա անձանց վրա: Պարզ ձևակերպմամբ՝ այս սահմանափակումը չի ազդի իրենց անձնական ավտոմեքենայով ՀՀ տուրիստական կամ գործնական այցելություններ իրականացնող օտարերկրացիների վրա:
