Արդարադատության նախարարությունն առաջարկում է փոփոխություն կատարել Քաղաքացիական օրենսգրքում: Մասնավորաբար, անշարժ գույքի նվիրատվության պայմանագրերի համար կսահմանվի նոտարական վավերացման պարտադիր պահանջ՝ առանց բացառության: Զուգահեռաբար կվերացվի Կադաստրի կոմիտեի կողմից նշված գործարքները կառավարության որոշմամբ սահմանված օրինակելի ձևով կնքելու իրավասությունը: Ըստ նախարարության, նախագծի ընդունումը կնպաստի անշարժ գույքի նվիրատվության գործարքների մասով քաղաքացիների և պետության իրավունքների առավել արդյունավետ պաշտպանությանը՝ հաշվի առնելով, որ նոտարներն ունեն առավել լայն լիազորություններ զսպելու հնարավոր շինծու գործարքների կնքման ռիսկը, ավելի արդյունավետ եղանակով կկենսագործվեն «Փողերի լվացման և ահաբեկչության ֆինանսավորման դեմ պայքարի մասին» օրենքով սահմանված նպատակները, առանձին դեպքերում կբարձրանա փողերի լվացման դեպքերի կանխման և բացահայտման արդյունավետությունը:

Քաղաքացիական օրենսգրքի գործող կարգավորումների համաձայն՝ անշարժ գույքի նկատմամբ իրավունքների ծագմանը, փոփոխմանը, փոխանցմանն ուղղված գործարքները (առք ու վաճառք, նվիրատվություն, վարձակալություն) ենթակա են նոտարական վավերացման, բացառությամբ, եթե դրանք կնքվում են Կառավարության կողմից սահմանված օրինակելի ձևերով, այդ դեպքում գործարքը կարող է կնքվել Կադաստրի կոմիտեում: Սակայն, ըստ նախարարության, օրենսդրական կարգավորումը նախատեսելիս հաշվի չեն առնվել գործարքի որոշ տեսակների առավել բարձր ռիսկայնությունը, հատկապես նվիրատվության գործարքների դեպքում առկա է առք ու վաճառքի գործարքը նվիրատվության գործարքի միջոցով քողարկելու ռիսկ:

Կադաստրի կոմիտեն չունի պարտավորություն և իրավասություն պարզելու պայմանագրի կողմի իրական կամքը, տրամադրելու խորհրդատվություն՝ ի տարբերություն նոտարի, որի վրա օրենքով դրված է պարտավորություն՝ նոտարական գործողություններ իրականացնելիս անձանց օգնություն ցույց տալու, նրանց իրավունքներն ու պարտականությունները պարզաբանելու, նոտարական գործողությունների կատարման հետևանքների մասին զգուշացնելու և այլնի վերաբերյալ: Այսինքն՝ նոտարն օրենքով իրեն վերապահված իրավասությունների շրջանակում ունի առավել լայն գործիքակազմ ապահովելու քաղաքացիների իրավական պաշտպանությունը, զերծ պահելու նրանց իրավական անտեղյակության հետևանքով այնպիսի գործարքների կնքումից, որոնք կարող են խախտել իրենց իսկ իրավունքները: Հաշվի առնելով սա, օրենսդրական փոփոխություններով առաջարկվում է այդպիսի գործարքների վավերացման իրավասությունը տրամադրել բացառապես նոտարներին:
