Արցախում օրենք են ընդունել ռազմական դրության պայմաններում ֆիզիկական և իրավաբանական անձանց գույքի օգտագործման վերաբերյալ

Արցախի նախագահի նախաձեռնությամբ հուլիսի 27-ին գումարված Ազգային ժողովի արտահերթ նստաշրջանում քննարկվել և ընդունվել է ««Ռազմական դրության իրավական ռեժիմի մասին» օրենքում փոփոխություններ և լրացումներ կատարելու մասին» օրենքի նախագիծը՝ հարակից օրինագծերով:
Ներկայացնելով առաջարկվող փոփոխություններն ու լրացումները, Արցախի նախագահի աշխատակազմի ղեկավարի առաջին տեղակալ Ժիրայր Միրզոյանն ընդգծեց ռազմական դրության պայմաններում գույքային իրավունքների կարգավորման անհրաժեշտությունը: Նրա խոսքով՝ 2020 թվականի պատերազմական գործողություններից հետո ««Ռազմական դրության իրավական ռեժիմի մասին» օրենքում կատարված փոփոխությամբ սահմանվել է հնարավորություն վճարի դիմաց օգտագործման վերցնել ֆիզիկական և իրավաբանական անձանց գույքը:
«Օրենքի փոփոխության հիման վրա ընդունված ենթաօրենսդրական ակտերով կարգավորվեցին պետբյուջեի միջոցների հաշվին ամենամսյա վճարի տրամադրման հետ կապված հարաբերությունները: Ներկայում գույքը վարձակալությամբ տված ֆիզիկական և իրավաբանական անձանց զգալի մասը գտնվում է Արցախի սահմաններից դուրս և գործնականում ստացվում է այնպես, որ գույքը հանձնվում է վարձակալության դրա դիմաց բռնի տեղահանվածներին բնակարանային ապահովության նպատակով, վճարները պետական բյուջեի միջոցներից են վճարվում, և այդ գումարները Արցախի սահմաններից դուրս են գնում»,-ներկայացրեց Միրզոյանը՝ հավելելով, որ ««Ռազմական դրության իրավական ռեժիմի մասին» օրենքում կատարվող փոփոխություններով առաջարկվում է ռազմական դրության պայմաններում ֆիզիկական և իրավաբանական անձանց գույքի օգտագործման դիմաց ամենամսյա վճար վճարելու պարտականությունը հանել:
Միաժամանակ գույքի օգտագործման անհրաժեշտության վերացման դեպքում, եթե գույքը վերադարձվում է վնասված, ապա գույքի օրինական տիրապետողի դիմումի հիման վրա նրան կտրվի համարժեք փոխհատուցում՝ Արցախի կառավարության սահմանած կարգով, ժամկետներում և չափով:
««Ռազմական դրության իրավական ռեժիմի մասին» օրենքում փոփոխություններ և լրացումներ կատարելու մասին» օրինափաթեթի իրավակարգավորումներով առավել հստակ և արդյունավետ կդառնան տեղական ինքնակառավարման մարմինների լիազորությունները՝ կապված հայտարարված ռազմական դրության հետ: Մտքերի փոխանակությունից հետո օրինագծերի փաթեթն ընդունվեց 18 կողմ, 9 դեմ ձայների հարաբերակցությամբ :
