Հայաստանի Հանրապետության արտաքին գործերի նախարարությունը ողջունում է Արդարադատության միջազգային դատարանի 2023թ․ հուլիսի 6-ի որոշումը, որի ամբողջական տեքստը կողմերին տրամադրվել է հուլիսի 11-ին։
«Դատարանը միաձայն վերահաստատում է 2023թ. փետրվարի 22-ի իր որոշումը՝ կրկին պարտավորեցնելով Ադրբեջանին, մինչև գործի վերաբերյալ վերջնական որոշման կայացումը, Ռասայական խտրականության բոլոր ձևերի վերացման մասին միջազգային կոնվենցիայով ստանձնած պարտավորություններին համապատասխան «ձեռնարկել իր տրամադրության տակ գտնվող բոլոր միջոցներն՝ ապահովելու Լաչինի միջանցքով անձանց, տրանսպորտային միջոցների և բեռների անխափան տեղաշարժը երկու ուղղություններով»:
Հուլիսի 6-ի պարտադիր իրավաբանական ուժ ունեցող որոշմամբ Դատարանը միաձայն հաստատում է, որ 2023թ․ փետրվարի 22-ի որոշումը «առանց սահմանափակման կիրառելի է» Ադրբեջանի կողմից տեղադրված անցակետի նկատմամբ և որ Լաչինի միջանցքում ադրբեջանական անցակետի առկայությունն ու շահագործումն իրավամբ ռասայական խտրականություն է:
Կարևոր է նշել, որ Դատարանը համարել է, որ «կողմերի միջև լարված իրավիճակը հաստատում է սույն որոշման արդյունավետ իրականացման անհրաժեշտությունը», որն ընդունվել է կանխելու էթնիկ հայերի՝ «Ռասայական խտրականության բոլոր ձևերի վերացման մասին» միջազգային կոնվենցիայով պաշտպանվող իրավունքներին անդառնալի վնաս հասցնելու անմիջական վտանգը, և որը միտումնավոր անտեսվել և մինչ օրս անտեսվում է Ադրբեջանի կողմից։
Այսպիսով, Դատարանը 2023թ. հուլիսի 6-ի որոշմամբ վերահաստատում է Ադրբեջանի միջազգային իրավական պարտավորությունը՝ ձեռնարկել առկա բոլոր միջոցները՝ ապահովելու Լաչինի միջանցքով անձանց, տրանսպորտային միջոցների և բեռների՝ երկու ուղղություններով անխափան տեղաշարժը և, ըստ այդմ, անհապաղ դադարեցնել իր անցակետի գործունեությունը, քանի որ դա անհերքելիորեն խոչընդոտում է Լեռնային Ղարաբաղում բնակվող հայերի՝ «Ռասայական խտրականության բոլոր ձևերի վերացման մասին» միջազգային կոնվենցիայով սահմանված իրավունքները:
Կարող ենք արձանագրել, որ Դատարանի հուլիսի 6-ի որոշումը ևս մեկ անգամ ապացուցում է, որ Ադրբեջանի` Դատարանի փետրվարի 22-ի որոշման կատարման վերաբերյալ պնդումները կեղծ էին և մանիպուլացնող:
Կոչ ենք անում նաև միջազգային մյուս դերակատարներին, և, մասնավորապես, ՄԱԿ-ի Անվտանգության խորհրդին, ձեռնարկել բոլոր քայլերը՝ ապահովելու Ադրբեջանի կողմից Դատարանի որոշման անհապաղ և արդյունավետ իրականացումը»,- ասված է ԱԳՆ հաղորդագրության մեջ:
