«Փաստ» օրաթերթը գրում է

Արդարադատության նախարարությունը հանրային քննարկման է ներկայացրել նախագիծ՝ առաջարկելով լրացում կատարել կառավարության 2014 թ. մայիսի 15-ի N 517Ն որոշման մեջ: Հակակոռուպցիոն կոմիտեն իր լիազորությունների շրջանակներում սահմանված կարգով իրականացնում է օպերատիվ-հետախուզական գործունեություն: Նրան իրավունք է վերապահված իրականացնել օրենքով նախատեսված բոլոր օպերատիվ-հետախուզական միջոցառումները, որոնց իրականացման համար անհրաժեշտ է ձեռք բերել օպերատիվ հետաքրքրություն ներկայացնող տեղեկություններ, դրանց հիմքում ընկած է գաղտնիության սկզբունքը:

Անհրաժեշտություն է առաջանում ապահովել օպերատիվ-հետախուզական միջոցառումների իրականացման ընթացքում տեղեկությունների հավաքման, պահպանման և փոխանցման անվտանգությունը, ինչպես նաև օպերատիվ ծառայողների միջև բարձր պաշտպանվածությամբ և անխափան կապը։ Ներկայում կոմիտեն չունի իրեն տրամադրված ռադիոհաճախականության տիրույթը և ստացված տեղեկությունների փոխանցումն իրականացնում է կապի գործող օպերատորների ծառայություններից օգտվելով։ Կոմիտեի օպերատիվ ստորաբաժանման ծառայողները, հնարավորինս պահպանելով գաղտնիության սկզբունքը, միմյանց միջև կապն ապահովում են սեփական տեխնիկական միջոցներով՝ օգտվելով նաև բջջային հեռախոսների համար նախատեսված զանազան հավելվածներից։

Օպերատիվ ծառայողների միջև նման միջոցներով կապն ապահովելն անվտանգ չէ և ունի պաշտպանվածության ավելի նվազ մակարդակ, քանի որ ներկայումս տեղեկատվական տեխնոլոգիաների զարգացվածությունը կոմիտեի ծառայողների կողմից փոխանցվող տեղեկատվությանը կողմնակի անձանց հասանելիության լայն հնարավորություններ է ընձեռում։ Այս հանգամանքները կարող են նպաստել օրենքով կոմիտեին վերապահված օպերատիվ գործառույթների իրականացման ընթացքում խոչընդոտների առաջացմանը։ Ուստի անհրաժեշտ է ապահովել կապի միջոցների անվտանգության ավելի բարձր մակարդակ՝ սահմանափակելով ստացված տեղեկությունների արտահոսքը։

Նախագծով առաջարկվում է Հակակոռուպցիոն կոմիտեն ընդգրկել կառավարական նշանակության ռադիոհաճախականությունների սպեկտրից ռադիոհաճախականությունների տիրույթների օգտագործման իրավասություն ունեցող սուբյեկտների ցանկում, որով կապահովվի օպերատիվ-հետախուզական միջոցառումների իրականացման ընթացքում ձեռք բերվող և փոխանցվող օպերատիվ հետաքրքրություն ներկայացնող տեղեկությունների անվտանգ հավաքումը և փոխանցումը:
