Օրենքը հունիսի 9-ից ուժի մեջ է մտել

Iravaban.net-ը հայտնում է, որ հունիսի 9-ին ուժի մեջ է մտնում Քրեական օրենսգրքում կատարված լրացումները, որոնց համաձայն՝ Հայաստանում քրեական պատիժ կսահմանվի ինքնիշխանությունից հրաժարվելուն՝ բռնություն գործադրելու կամ բռնություն գործադրելու սպառնալիքով ՀՀ ինքնիշխանությունը լրիվ կամ մասնակի սահմանփակելուն ուղղված գործողություններ կատարելու, ինչպես նաև ինքնիշխանությունից հրաժարվելուն ուղղված հրապարակային կոչերի համար:
Նախագիծն ԱԺ նիտում ներկայացնելիս Արդարադատության նախարարի տեղակալ Լևոն Բալյանը հայտնել էր, որ ներկայում գործող Քրեական օրենսգրքում քրեական պատասխանատվություն է նախատեսված սահմանադրական կարգը տապալելու, ներառյալ Սահմանադրության 1-ին հոդվածի գործողությունը փաստացի դադարեցնելու և դրան ուղղված բռնի կոչերի համար: Բալյանը նշել էր, որ գործող Քրեական օրենսգրքով ինքնիշխանությունից բռնի հրաժարվելուն ուղղված գործողությունների կամ հրապարակային կոչերի համար քրեական պատասխանատվություն նախատեսված չէ, մինչդեռ ինքնիշխանությունը պետության, որպես սուբյեկտի, հիմնական հատկությունն է:
«Նախագծի ընդունման արդյունքում քրեորեն պատժելի արարքներ են համարվելու ինքնիշխանությունից հրաժարվելուն ուղղված գործողություններ կատարելը։ Դրանք են՝ բռնություն գործադրելու կամ բռնություն գործադրելու սպառնալիքի միջոցով ՀՀ ինքնիշխանությունը լրիվ կամ մասնակի սահմանափակելուն ուղղված գործողությունները: Քրեականացվելու են նաև նման գործողություններ կատարելուն, այսինքն՝ ինքնիշխանությունից հրաժարվելուն ուղղված հրապարակային կոչերը: Ինքնիշխանությունից հրաժարվելուն ուղղված գործողություններ կատարելը պատժվելու է ազատազրկմամբ՝ 10-15 տարի ժամկետով, իսկ դրանց ուղղված հրապարակային կոչերը, տարբեր պատժատեսակներով՝ սկսած տուգանքից մինչև վաղաժամկետ ազատազրկում, առավելագույնը 2 ամիս ժամկետով կամ ազատազրկում՝ առավելագույնը 3 տարի ժամկետով»,-ասել էր Բալյանը ԱԺ նիստում:
Իսկ եթե կոչերը կատարվել են՝ հրապարակային ցուցադրվող ստեղծագործությունները կամ ԶԼՄ-ները կամ տեղեկատվական տեխնոլոգիաներն օգտագործելով, ապա կարող է սպառնալ մինչև 2-5 տարի ժամկետով ազատազրկում:
Վաղվանից քրեորեն պատժելի արարքներ են համարվելու ինքնիշխանությունից հրաժարվելուն, բռնություն գործադրելու կամ բռնություն գործադրելու սպառնալիքով ՀՀ ինքնիշխանությունը լրիվ կամ մասնակի սահմանփակելուն ուղղված գործողություններ կատարելը, ինչպես նաև ինքնիշխանությունից հրաժարվելուն ուղղված հրապարակային կոչերը:
