ՊՆ-ին ամրացված «հատուկ նշանակության» հողամասը 2 մլն 983 հազար դրամով վաճառել են քաղաքացուն

Պաշտպանության նախարարությունը, 2013 թվականի դեկտեմբերի 6-ին կնքված անշարժ գույքի առուվաճառքի պայմանագրով, խախտելով մի շարք օրենսդրական պահանջներ ու կարգավորումներ, Նախարարությանն անհատույց օգտագործման իրավունքով ամրացված՝ Գյումրի քաղաքի Լալայան փողոցում գտնվող շինությունները և «հատուկ նշանակության» 0.119995 հա հողամասը, ուղղակի վաճառքով՝ 2 մլն 983 հազար դրամով, վաճառել է քաղաքացի Մ.Մ.-ին: Այս մասին տեղեկանում ենք ՀՀ Գլխավոր դատախազության պաշտոնական կայքից։
Զինվորական կենտրոնական դատախազության պետական շահերի պաշտպանության բաժնի կողմից 2023 թվականի ապրիլ ամսվա ընթացքում կատարված ուսումնասիրությամբ պարզվել է, որ Մ.Մ.-ն ձեռք բերված անշարժ գույքը 2021 թվականի նոյեմբերի 25-ին գրավադրել է 16 մլն 700 հազար դրամով՝ ձեռքբերման գնից 6 անգամ թանկ:
Ուսումնասիրությամբ տվյալներ են ձեռք բերվել նաև այն մասին, որ «Կենտրոն» նոտարական տարածքի նոտար Ա.Ա.-ն, անտեսելով Անշարժ գույքի կադաստրի կոմիտեի կողմից տրված տեղեկանքը, համաձայն որի՝ տարածքը «հատուկ նշանակության» է, վավերացրել է պայմանագիրը, Կոմիտեի աշխատակիցներն իրականացրել են իրավունքների պետական գրանցում՝ քաղաքացուն տալով սեփականության իրավունքի վկայական, իսկ Պաշտպանության նախարարության պաշտոնատար անձինք, առանց պետական սեփականություն հանդիսացող հողամասն ուղղակի վաճառքի ձևով օտարելու համար բավարար հիմքերի, այն վաճառել են քաղաքացուն։
Նկատի ունենալով, որ ուսումնասիրությամբ պարզված հանգամանքներն առերևույթ պարունակում են Քրեական օրենսգրքով նախատեսված արարքի հատկանիշներ՝ Դատախազությունը 2023 թվականի ապրիլի 25-ին ուսումնասիրության արդյունքներն ուղարկել է Հակակոռուպցիոն կոմիտե՝ քրեական վարույթ նախաձեռնելու հարցը լուծելու համար։
2023 թվականի ապրիլի 28-ին Հակակոռուպցիոն կոմիտեում նախաձեռնվել է քրեական վարույթ՝ Քրեական օրենսգրքի 441-րդ հոդվածի 1-ին մասով (պաշտոնատար անձի կողմից իր իշխանական կամ ծառայողական լիազորությունները կամ դրանցով պայմանավորված ազդեցությունն ի վնաս պետական կամ ծառայողական շահերի օգտագործելը կամ իր ծառայողական պարտականությունը չկատարելը կամ ոչ պատշաճ կատարելը կամ այնպիսի արարք կատարելը, որը չի բխում իր լիազորություններից կամ դուրս է իր լիազորությունների շրջանակից, որն էական վնաս է պատճառել անձի կամ կազմակերպության իրավունքներին, ազատություններին կամ օրինական շահերին կամ հասարակության կամ պետության օրինական շահերին):
