«Փաստ» օրաթերթը գրում է

Արդարադատության նախարարությունն առաջարկում է լրացում կատարել Վարչական դատավարության օրենսգրքում: Նախագծով առաջարկվում է Վարչական դատավարության օրենսգրքում ևս վարչական կարգով քննվող որոշակի վեճերի համար (հանրային ծառայության իրականացման ընթացքում կարգապահական պատասխանատվության ենթարկվելու, հանրային ծառայությունից ազատվելու հետ կապված վեճեր) նախատեսել ինչպես գործի քննության հստակ և կրճատ ժամկետ, այնպես էլ առանձին դատավարական գործողությունների կատարման հստակ և կրճատ դատավարական ժամկետներ:

Առաջարկվում է Վարչական դատավարության օրենսգրքում հատուկ վարույթների շրջանակում ավելացնել նոր՝ 31.9 գլուխ, որով սահմանված կարգով կքննվեն հանրային ծառայություն իրականացնելու ընթացքում կարգապահական պատասխանատվության ենթարկվելու, ծառայությունից ազատելու հետ կապված վեճերով գործերը: Նախագծով նախատեսվող կարգավորումների համաձայն՝ նշված վեճերը Վարչական դատարանում քննվում և լուծվում են հայցադիմումը վարույթ ընդունելուց հետո երեք ամսվա ընթացքում, համապատասխան գործերը դատարանը քննում է միանձնյա, դատարանը հայցադիմումը վարույթ ընդունելու հարցը լուծում է այն ստանալուց հետո եռօրյա ժամկետում, հայցադիմումը վարույթ ընդունելու հետ միաժամանակ դատարանը կայացնում է որոշում՝ պատասխանողից ապացույցներ պահանջելու մասին, որը կատարման ենթակա է պատասխանողի կողմից որոշումն ստանալուց հետո մեկշաբաթյա ժամկետում, հայցադիմումի պատասխանը ներկայացվում է հայցադիմումը վարույթ ընդունելու մասին որոշումն ստանալուց հետո մեկշաբաթյա ժամկետում:

Նախագծի նպատակն է հանրային ծառայությունից ազատվելու հետ կապված վեճերի քննման համար նախատեսել հստակ և սեղմ դատավարական ժամկետներ՝ արդյունքում ունենալով գործատուի մեղքով աշխատակցի աշխատանքից ազատման հետևանքով հարկադիր պարապուրդում գտնվելու ժամանակահատվածի համար հատուցում ստանալու ավելի արդարացված կարգավորումներ: Քննարկվող բնույթի վեճերը Վարչական դատարանում կքննվեն ավելի արագ, հայցի բավարարման դեպքում առավել արդյունավետ կիրականացվի անօրինական հիմքերով աշխատանքից ազատված աշխատողի խախտված իրավունքների վերականգնումը, ինչպես նաև ավելորդ մեծածավալ փոխհատուցման բեռ չի սահմանվի գործատուի համար:
