Ծայրահեղ քաղաքական կուրություն․ ՀՀԿ-ն՝ ՍԴ-ի կողմից «Հռոմի ստատուտ»-ի վերաբերյալ որոշման մասին

ՀՀԿ Գործադիր մարմնի հայտարարությունը․
«Ս. թ. մարտի 24-ին ՀՀ Սահմանադրական դատարանը կառավարության դիմումի հիման վրա ընդունել է որոշում, ըստ որի Միջազգային քրեական դատարանի Հռոմի կանոնադրությունում ամրագրված պարտավորությունները համապատասխանում են ՀՀ Սահմանադրությանը:
Հայաստանի իշխանությունների այս որոշումը ներկա աշխարհաքաղաքական իրավիճակում ծայրահեղ քաղաքական կուրություն է եւ հղի է անկախատեսելի հետեւանքներով:
Գաղտնիք չէ, որ Միջազգային քրեական դատարանը չափազանց քաղաքականացված մարմին է եւ բոլորովի էլ պատահական չէ, որ նույնիսկ ՄԱԿ Անվտանգության խորհրդի մշտական անդամներ հանդիսացող այնպիսիհզոր տերություններ, ինչպիսիք են ԱՄՆ, Չինաստանը եւ Ռուսաստանը, չեն ստորագրել կամ վավերացրել այդ կանոնադրությունը եւ նման մտադրություն չունեն նաեւ ապագայում:
Ակնհայտ քաղաքական կարճատեսություն է կարծելը, որ այդ դատարանին միանալը կարող է երբեւէ օգտագործվել Հայաստանի շահերի պաշտպանության համար:
Միաժամանակ հարկ է նաեւ արձանագրել, որ Հայաստանի Սահմանադրական դատարանը, որը 2020 թ. Սահմանադրության հակասահմանադրական փոփոխությունների արդյունքում ապօրինի կազմ ունի, բացահատորեն վերազանցել է իր լիազորությունները եւ կայացրել ակնհայտ ապօրինի որոշում:
Թե Սահմանադրությամբ, թե Սահմանադրական դատարանի մասին Սահմանադրական Օրենքով Սահմանադրական դատարանն իրավասու չէր քննության ընդունել Միջազգային քրեական դատարանի կանոնադրությունում ամրագրված պարտավորությունների սահմանադրականության գործը, այն պարագայում, երբ նույն հարցի վերաբերյալ Սահմանադրական դատարանը դեռեւս 2004 թ. արդեն իսկ կայացրել էր բացասական որոշում:
Քանի որ Սահմանադրական դատարանի որոշումները վերջնական են և վերանայման ենթակա չեն, ապա իրավական առումով Միջազգային քրեական դատարանի անդամակցության խնդրի վերանայումը հնարավոր էր միայն Սահմանադրությունում համապատասխան փոփոխություն կատարելուց հետո»։
