«Փաստ» օրաթերթը գրում է

Ներքին գործերի նախարարությունն առաջարկում է լրացում կատարել կառավարության 2021 թ. ապրիլի 15-ի թիվ 587-Ն որոշման մեջ։ «Պետական սեփականություն հանդիսացող և պետական ոչ առևտրային կազմակերպությունների սեփականությունը հանդիսացող գույքի վաճառքի, վաճառքի մրցույթի և աճուրդի կազմակերպման ու անցկացման կարգերը սահմանելու և կառավարության 2003 թ.-ի հունիսի 13-ի N 882-Ն որոշումն ուժը կորցրած ճանաչելու մասին» թիվ 587-Ն որոշման 1-ին հավելվածով սահմանված է պետական կառավարման համակարգի մարմինների տիրապետմանը և օգտագործմանը հանձնված, ՊՈԱԿ-ներին, պետական մասնակցությամբ առևտրային կազմակերպություններին և հիմնադրամներին անհատույց օգտագործման իրավունքով տրամադրված պետական սեփականություն հանդիսացող գույքի վաճառքի կարգը:

Նույն հավելվածի 3-րդ կետի համաձայն՝ պետգույքի վաճառքն իրականացվում է աճուրդով (այդ թվում` էլեկտրոնային), մրցույթով կամ ուղղակի վաճառքի եղանակով` պետգույքի վաճառքի մասին ընդունված իրավական ակտի հիման վրա։ Ներքին գործերի նախարարության ոստիկանությանն ամրացված տրանսպորտային միջոցները մինչ օրս հիմնականում վաճառվել են աճուրդով։

Կառավարության 2022 թ. սեպտեմբերի 1-ի թիվ 1377 որոշման համաձայն՝ շուրջ 168 տրանսպորտային միջոց հետ է վերցվել և ամրացվել տարածքային կառավարման և ենթակառուցվածքների նախարարության պետգույքի կառավարման կոմիտեին՝ հետագայում օտարելու նպատակով։ Որոշման 1-ին հավելվածի 3-րդ կետի 1-ին ենթակետի համաձայն՝ պետգույքը վաճառվում է ուղղակի եղանակով գործարար (ներդրումային) ծրագիր ներկայացրած, նախօրոք հայտնի գնորդին և տվյալ գույքի վարձակալին, եթե գույքի վաճառքի մասին իրավական ակտով այլ բան նախատեսված չէ։

Ներկայում ոստիկանությանն ամրացված տանսպորտային միջոցների շահագործումը, ինչպես նաև հետագա օգտագործման արդյունավետությունը բարձրացնելու նպատակով անհրաժեշտություն է առաջացել սահմանելու ուղղակի վաճառքի պարզեցված կարգ: Նախագծով նախատեսվում է իրավական հիմք ստեղծել պետական կառավարման համակարգի մարմնին ամրացված տրանսպորտային միջոցներն ուղղակի եղանակով, առանց ներդրումային ծրագիր ներկայացնելու, պահանջի օտարելու համար։

Նախագծով պետական կառավարման համակարգի մարմնին՝ համապատասխան ոլորտը կարգավորող օրենքով սահմանված խնդիրներն իրականացնելու նպատակով ամրացված տրանսպորտային միջոցներն ուղղակի վաճառքի եղանակով ձեռք բերելու հնարավորություն է տրվում տվյալ տրանսպորտային միջոցը շահագործողին։ Տրանսպորտային միջոցը շահագործող անձը մեկ անգամ կարող է լինել տվյալ գույքի գնորդ, իսկ մի քանի գնորդ լինելու դեպքում ընտրությունը կատարվում է նախագծով ներկայացված չափորոշիչների հիման վրա։
