Ռուբեն Վարդանյանի նոր նախաձեռնությունը

Արցախի նախկին պետնախարար Ռուբեն Վարդանյանի նոր նախաձեռնությունը կարող է լրջագույն աջակցություն դառնալ Լեռնային Ղարաբաղի հիմնախնդրի կարգավորման համար։
Վարդանյանի նախաձեռնությամբ և հայտնի փաստաբան, ՀՀ ԱԺ նախկին պատգամավոր Տարոն Սիմոնյանի գլխավորած իրավաբանական թիմի հետ համատեղ մշակվել է ծավալուն՝ մոտ 120 էջանոց դիմում-վերլուծություն՝ ուղղված Ցեղասպանության կանխարգելման գծով ՄԱԿ-ի Գլխավոր քարտուղարի հատուկ խորհրդականին։
Ինքը՝ Ռուբեն Վարդանյանը, որպես այդ կարևոր քայլի պատճառ, նշել է Արցախի Հանրապետության բնակչության առջև 2020թ-ի պատերազմի ընթացքում, դրանից հետո և արդեն հարյուր օր տևող շրջափակման պայմաններում ծառացած գոյապահպանական լուրջ մարտահրավերը, նաև այն, որ Ադրբեջանի պետական քաղաքականությունը միտված է բացառապես Արցախը հայաթափելուն, այդ թվում՝ ցեղասպանություն կազմակերպելու և իրականացնելու միջոցով։ Ըստ նախկին պետնախարարի, վերլուծությունը մշակվել է ոչ միայն ՄԱԿ-ի կանոնադրության, ՄԱԿ-ի Գլխավոր ասամբլեայի բանաձևերի, միջազգային կոնվենցիաների, այլ նաև 2014թ-ին ՄԱԿ-ի կողմից հրապարակված «Framework of Analysis for Atrocity Crimes: A tool for prevention» փաստաթղթի հիման վրա, որտեղ ներկայացված են Ընդհանուր 8 և Հատուկ 6 ռիսկային գործոններ։
Այս գործոններից մի քանիսի առկայությունն անգամ բավարար է ցեղասպանության վտանգը իրական համարվելու համար, ինչը պահանջում է անհրաժեշտ գործողություններ միջազգային հանրությունից՝ վերահաս ցեղասպանությունը կանխարգելելու նպատակով։
«Վերլուծությունն իրավական և փաստական հիմնավորումներ է բերում բոլոր 14 գործոններով և դրանց ներքո ներկայացված ենթագործոններով՝ օգտվելով մինչ այս եղած ազգային և միջազգային կազմակերպությունների փաստահավաք եզրակացություններից և միջազգային իրավունքի կարգավորումներից։
Հատկանշական է, որ վերլուծության արդյունքում ապացուցվում է, որ Արցախի ժողովրդի նկատմամբ վերահաս ցեղասպանության վտանգը հիմնավորվում է ոչ թե ՄԱԿ-ի կողմից որոշակիացված մեկ-երկու գործոնների, այլ բոլոր՝ 14 գործոնների շրջանակներում»,- նշել է Ռուբեն Վարդանյանը:
