«Փաստ» օրաթերթը գրում է

Արդարադատության նախարարությունն առաջարկում է փոփոխություն կատարել «ՀՀ դատական օրենսգիրք» սահմանադրական օրենքում: 2022 թ. դեկտեմբերի 23-ին այդ օրենքում կատարված փոփոխությունների և լրացումների համաձայն նախատեսվում է, որ վերաքննիչ հակակոռուպցիոն դատարանի ստեղծման վերաբերյալ նորմերը ուժի մեջ են մտնելու 2024 թ. հունվարի 1-ից: Վերաքննիչ հակակոռուպցիոն դատարանը իրականացնելու է հակակոռուպցիոն քաղաքացիական և կոռուպցիոն հանցագործությունների վերաբերյալ գործերով կայացված դատական ակտերի վերաքննության կարգով վերանայումը, դատարանը կազմված է լինելու առնվազն 12 դատավորից, որոնցից առնվազն 6-ն իրականացնելու են կոռուպցիոն հանցագործությունների վերաբերյալ գործերով, և առնվազն 6-ը՝ հակակոռուպցիոն քաղաքացիական գործերով կայացված դատական ակտերի դեմ բողոքների քննություն:

Այսինքն, վերաքննիչ հակակոռուպցիոն դատարանում կոռուպցիոն հանցագործությունների գործերով կայացված ակտերով վերանայման գործերը բաշխվելու են միայն կոռուպցիոն հանցագործությունների քննության մասնագիտացմամբ, իսկ հակակոռուպցիոն քաղաքացիական գործերով կայացված ակտերի վերանայման գործերը՝ միայն հակակոռուպցիոն քաղաքացիական գործերի քննության մասնագիտացմամբ դատավորների միջև: Սակայն ներկայացված իրավակարգավորման համատեքստում, մինչև այս նորմի ուժի մեջ մտնելը, ստեղծվում է իրավիճակ, երբ առաջին ատյանի կարգով հակակոռուպցիոն գործերի քննությունն իրականացվում է մասնագիտացված՝ հակակոռուպցիոն դատարանի կողմից, իսկ այդ գործերով կայացված ակտերի վճռաբեկության կարգով վերանայումն իրականացվում է Վճռաբեկ դատարանի առանձին մասնագիտացված՝ հակակոռուպցիոն պալատի կողմից, սակայն այդ նույն ակտերի վերաքննությունը իրականացնում են վերաքննիչ քաղաքացիական և վերաքննիչ քրեական դատարանները:

Առկա իրավիճակը և ինստիտուտի բնականոն ու լիարժեք կենսագործունեությունը պահանջում է, որպեսզի մասնագիտացման գործոնը հստակ արտահայտված լինի տվյալ տեսակի գործերի քննության իրավասությամբ օժտված բոլոր դատական ատյաններում՝ օրենքով սահմանված ժամկետից ավելի վաղ ժամկետում: Նշվածը հնարավորություն կստեղծի կոռուպցիոն հանցագործությունների և հակակոռուպցիոն քաղաքացիական գործերով բողոքարկման ենթակա դատական ակտերի վերանայումն իրականացնել ոչ թե վերաքննիչ քրեական և վերաքննիչ քաղաքացիական դատարանների, այլ հենց նեղ մասնագիտացված՝ վերաքննիչ հակակոռուպցիոն դատարանի կողմից:

Այսպիսով, նախագծի ընդունման արդյունքում ապրիլի 1-ից վերաքննիչ քրեական և վերաքննիչ քաղաքացիական դատարանները դադարելու են քննել համապատասխանաբար կոռուպցիոն հանցագործությունների և հակակոռուպցիոն քաղաքացիական գործերով բողոքարկման ենթակա դատական ակտերը: Այս օրենքի ընդունմամբ վերաքննիչ հակակոռուպցիոն դատարանում հավել յալ հաստիքների ավելացմամբ պայմանավորված՝ պետբյուջեում լրացուցիչ ծախսերը կկազմեն ընդամենը մոտ 69 մլն դրամ։
