ՀՀ քննչական կոմիտեի Լոռու մարզային քննչական վարչության Սպիտակի քննչական բաժնում քննվող քրեական վարույթի շրջանակներում իրականացվում են քննչական և վարութային գործողություններ՝ ոստիկանության ծառայողների օրինական ծառայողական գործունեությանը միջամտելու դեպքի հանգամանքները պարզելու ուղղությամբ:

ՀՀ քրեական օրենսգրքի 452 հոդվածի 1-ին և 3-րդ մասերով նախաձեռնված քրեական վարույթի նախաքննությամբ փաստական տվյալներ են ձեռք բերվել այն մասին, որ 2023 թվականի հունվարի 27-ին` ժամը 15:00-ի սահմաններում, պարեկային ծառայության երկու պարեկ Սպիտակ համայնքի Երևանյան խճուղում ծառայություն իրականացնելու ժամանակ ստուգման նպատակով կանգնեցրել են «Mercedes-Benz C230» մակնիշի ավտոմեքենա։ Դրա վարորդը՝ Սպիտակ քաղաքի 33-ամյա բնակիչը, ներկայացրել է ավտոմեքենայի հաշվառման վկայագիրն ու այլ անձի լուսանկարով վարորդական իրավունքի վկայական: Այնուհետև ոստիկանության պարեկները վարորդին հայտնել են տեխնիկական միջոցով անձի նույնականացում կատարելու անհրաժեշտության մասին, ինչից նա հրաժարվել է և հայհոյանքներ հնչեցնելով քայլել ավտոմեքենայի ուղղությամբ: Նման վարքագիծը կանխելու նպատակով՝ ոստիկանները որոշել են վարչական կարգով ձերբակալել 33-ամյա տղամարդուն։ Պարեկների մոտենալուց հետո, նա սկսել է ձեռքերով և ոտքերով հարվածներ հասցնել պարեկների մարմնի տարբեր մասերին, հնչեցնել հայհոյանքներ, սպառնալիքներ: Միևնույն ժամանակ, հիշյալ ավտոմեքենայի ուղևորը նույնպես սպառնալիքներ և հայհոյանքներ է հնչեցրել ոստիկանների հասցեին:

«Mercedes-Benz C230» մակնիշի ավտոմեքենայի վարորդը և ուղևորը, ովքեր եղբայրներ են, ձերբակալվել են:

Նախաքննության ընթացքում կատարվել է դեպքի վայրի զննություն, հիշյալ պարեկները ճանաչվել են տուժող, հարցաքննվել են մի շարք անձինք, նշանակվել են դատաբժշկական փորձաքննություններ:

Հսկող դատախազի կողմից հարուցված հանրային քրեական հետապնդման հիման վրա եղբայրներից մեկին՝ վարորդին, մեղադրանք է ներկայացվել ՀՀ քրեական օրենսգրքի 452-րդ հոդվածի 3-րդ մասի, իսկ մյուս եղբորը՝ ուղևորին՝ նույն հոդվածի 1-ին մասի հատկանիշներով։

Քննիչի կողմից միջնորդություն է ներկայացվել դատարան՝ նրանց նկատմամբ կալանքը որպես խափանման միջոց ընտրելու վերաբերյալ։

Նախաքննությունը շարունակվում է:

Ծանուցում. Հանցանքի համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
