ՄԻԵԴ-ի վճռով Հայաստանը պարտավորվում է կալանավայրում մահացած Ս․ Ոսկանյանի կնոջը փոխհատուցել 20 000 եվրո

Մարդու իրավունքների եվրոպական դատարանի վճռով Հայաստանի Հանրապետությունը պարտավորվում է Ս․ Ոսկանյանի կնոջը փոխհատուցել 20 000 եվրո՝ որպես բարոյական վնասի փոխհատուցում՝ կյանքի իրավունքի խախտման համար։ Այս մասին հաղորդում է Հելսինկյան քաղաքացիական ասամբլեայի Վանաձորի գրասենյակը:
2010 թվականի հոկտեմբերի 7-ից Ս․Ոսկանյանը գտնվել է կալանավայրում, որտեղ, օրեր անց, սկսել է բողոքել ոտքի շրջանոմ ցավերից և հայտնել, որ ինքն իրեն թուք է ներարկել։ Կալանավայրի բժիշկը, տեղյակ լինելով իրավիճակից՝ Ոսկանյանի շարունակական գանգատներից և վատթարացող առողջական խնդրից, նրան չի ուղեգրել կալանավայրի գլխավոր հիվանդանոց, ինչի արդյունքում էլ հոկտեմբերի 24-ին Ոսկանյանը մահացել է։ 2010 թվականի դեկտեմբերի 30-ին քրեական գործ է հարուցվել բժիշկ Մ.-ի նկատմամբ՝ բժշկական անփութության հատկանիշներով։
2011 թվականի օգոստոսի 30-ին դատարանը որոշել է կարճել քրեական գործի վարույթը և դադարեցնել բժիշկ Մ.-ի նկատմամբ քրեական հետապնդումը՝ հանցակազմի բացակայության պատճառով։
Հելսինկյան քաղաքացիական ասամբլեայի Վանաձորի գրասենյակը, պատվիրակված փաստաբան՝ Կ․ Թումանյան, հայցով դիմել է Մարդու իրավունքների եվրոպական դատարան՝ Կոնվենցիայի 2-րդ մասի խախտման հիմքով։
ՄԻԵԴ-ը հայցը բավարարել է՝ հաշվի առնելով Ս. Ոսկանյանին ցուցաբերած թերի բուժօգնության վերաբերյալ փորձագիտական խմբի միաձայն կարծիքը։
Դատարանը գտնում է, որ ներպետական իշխանությունները, տեղյակ լինելով
Ոսկանյանի վարակի մասին, չեն իրականացրել իրենց պարտավորությունները։
Դատարանը գտնում է, որ իշխանությունները չեն կարողացել մանրակրկիտ և ամբողջական քննել Ս․ Ոսկանյանի մահվան դեպքը, տեղի է ունեցել Կոնվենցիայի 2-րդ հոդվածի խախտում։
