Ինկասացիոն կազմակերպությունների աշխատողների կողմից օգտագործվող զենքի տեսակներից փոխվում են. նախագիծ. «Փաստ»

«Փաստ» օրաթերթը գրում է
Ոստիկանությունն առաջարկում է փոփոխություններ և լրացումներ կատարել կառավարության 2005 թ. օգոստոսի 25-ի թիվ 1359-Ն որոշման մեջ, մասնավորաբար, նախագծով առաջարկվում է ինկասացիոն կազմակերպությունների աշխատողների կողմից օգտագործվող զենքի տեսակներից հանել «ազդանշանային զենքը» և «գազային՝ ատրճանակ և ռևոլվեր» և վերջիններիս կողմից օգտագործվող զենքի տեսակները լրացնել «մարտական՝ ձեռքի մարտական հրաձգային» զենքով, ինչպես նաև որոշման նախաբանում կատարել փոփոխություններ նոր իրավական հիմքը ունենալու կապակցությամբ։
Այսպիսով` նախագծով առաջարկվում է որոշման 1-ին կետի «ա» ենթակետը շարադրել նոր խմբագրությամբ, ինչի արդյունքում ինկասացիոն կազմակերպությունների աշխատողների կողմից օգտագործվող զենքի տեսակներից կհանվի ազդանշանային զենքը, քանի որ «Զենքի շրջանառության կարգավորման մասին» ՀՀ օրենքի 4-րդ հոդվածում, որպես քաղաքացիական զենքի տեսակ ազդանշանային զենք այլևս նախատեսված չէ։ Բացի այդ նույն օրենքի 31-րդ հոդվածի 12-րդ կետի համաձայն՝ ազդանշանային սարքերը հաշվառման (գրանցման) ենթակա չեն, հետևաբար ձեռք են բերվում առանց թույլտվության։
Միաժամանակ նախագծով նախատեսվում է ինկասացիոն կազմակերպությունների աշխատողների կողմից օգտագործվող զենքի տեսակների ցանկից հանել գազային՝ ատրճանակը և ռևոլվերը, քանի որ արցունքաբեր կամ գրգռիչ նյութերով լիցքավորված փամփուշտներով ատրճանակի կամ ռևոլվերի նմանվող սարքերը բավարար չեն ապահովելու հուսալի անվտանգություն ինկասացիոն կազմակերպությունների առջև դրված խնդիրների իրականացման համար։ Նախագծով առաջարկվում է նաև որոշման 2-րդ կետը ուժը կորցրած ճանաչել, քանի որ «Զենքի շրջանառության կարգավորման մասին» ՀՀ օրենքի 16-րդ հոդվածով արդեն իսկ նախատեսել է ՀՀ ոստիկանության կողմից ինկասացիոն ծառայություններին մարտական զենք տրամադրելու իրավակարգավորումը։
Բացի այդ նախագծի 1-ին կետի 2-րդ ենթակետով արդեն իսկ մարտական՝ ձեռքի մարտական հրաձգային զենքը նախատեսվում է որպես ինկասացիոն կազմակերպությունների աշխատողների կողմից օգտագործվող զենքի տեսակների ցանկում: Նախագծի ընդունումը լրացուցիչ ֆինանսական միջոցների հատկացման, ինչպես նաև պետբյուջեի եկամուտներում և ծախսերում փոփոխություններ կատարելու անհրաժեշտություն չի առաջացնելու:
