Հարկադիր կատարողը «Դատական ակտերի հարկադիր կատարման մասին» օրենքի 43․1․-րդ հոդվածի հիման վրա կատարողական գործողությունների կատարման նպատակով ունի պարտապանին սեփականության իրավունքով պատկանող բնակարան կամ այլ շինություն անարգել, այդ թվում՝ բնակարանը կամ այլ շինությունը բացելու միջոցով մուտք գործելու իրավունք։ Այս մասին պարզաբանում է ԴԱՀԿ մամուլի ծառայությունը՝ անդրադառնալով Ֆիրդուս թաղամասում այսօր տեղի ունեցած միջադեպին։

«Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանի կողմից 06․12․2022թ․-ին տրամադրվել է կատարողական թերթ, որի համաձայն՝ անհրաժեշտ է Հարկադիր կատարումն ապահովող ծառայության միջոցով ապահովել «Հայաստանի Հանրապետության փորձագիտական կենտրոն» ՊՈԱԿ փորձագետի/փորձագետների մուտքը Հանրապետության 8ա հասցե՝ ԵԴ/56674/02/2021 քաղաքացիական գործով 2022 թվականի հոկտեմբերի 13-ին նշանակված դատաապրանքագիտական փորձաքննության կատարման ընթացքն ապահովելու համար։

Հարկադիր կատարողների կողմից այսօր Հանրապետության 8ա հասցեում իրականացվել են կատարողական գործողություններ՝ ապահովելու նշված կատարողական թերթի կատարումը։ Կատարողական թերթի հիման վրա կատարման ենթակա գործողություններն արդեն ավարտվել են։

Միաժամանակ հարկ ենք համարում տեղեկացնել, որ հարկադիր կատարողը «Դատական ակտերի հարկադիր կատարման մասին» օրենքի 43․1․-րդ հոդվածի հիման վրա կատարողական գործողությունների կատարման նպատակով ունի պարտապանին սեփականության իրավունքով պատկանող բնակարան կամ այլ շինություն անարգել, այդ թվում՝ բնակարանը կամ այլ շինությունը բացելու միջոցով մուտք գործելու իրավունք։ «Հարկադիր կատարումն ապահովող ծառայության մասին» օրենքի 47-49-րդ հոդվածների համաձայն՝ իրեն ցույց տրված դիմադրությունը կամ ծառայողական պարտականությունների կատարման կապակցությամբ իր վրա կատարված հարձակումը կանխելու դեպքում հարկադիր կատարողն ունի ֆիզիկական ուժ և հատուկ միջոցներ գործադրելու, իսկ նրա կյանքին կամ առողջությանն սպառնացող իրական վտանգի առկայության դեպքում՝ հրազեն գործադրելու իրավունք»,- հայտնում են ԴԱՀԿ-ից։

Հիշեցնենք, որ Ֆիրդուս թաղամասում լարված իրավիճակ է։ ԴԱՀԿ ծառայողները, կոտրելով դարպասները, փորձում են մուտք գործել Ֆիրդուս թաղամասում գտնվող տներ և պահեստներ՝ փորձագետների մուտքն այնտեղ ապահովելու համար։ Բնակիչները, սակայն, թույլ չեն տալիս, նշում են՝ իրենց տունն է, իրավունք ունեն թույլ չտալու։
