Շատ կարևոր է, որ ՄԻԵդ որոշման մեջ նշված է նոյեմբերի 9-ի հայտարարության մասին, իսկ այդ հայտարարությունում հստակ նշված է Լաչինի միջանցքով մարդկանց բեռների, մեքենաների ազատ տեղաշարժն ապահովելու մասին: Պատահական չէ, որ դատարանը մեջբերում է այդ հայտարարությունը: Այսինքն, սա նշանակում է, որ մենք հիմա կարող ենք վեր կենալ, գնալ ու անցնել Լաչինի միջանցքով։
Այս մասին այսօր լրագրողների հետ զրույցում ասաց Միջազգային իրավական հարցերով ՀՀ ներկայացուցիչ Եղիշե Կիրակոսյանը, անդրառնալով ՄԻԵԴ–ի կողմից Հայաստանի պահանջը բավարարելուն։
Եղիշե Կիրակոսյանն ասաց, որ ՄԻԵԴ որոշմամբ՝ Ադրբեջանի կողմից գերքայլեր չեն էլ ակնկալում, գործիքակազմն ունի սահմանափակումներ, բայց կան նաև այլ հարթակներ, որոնք Ադրբեջանին կպարտավորեցնեն քայլեր անել, օրինակ կա Նախարարների կոմիտեն, որը լինելով Եվրոպայի խորհրդի քաղաքական հիմնական մարմինը, հետևում է նաև դատարանի վճիռների կատարման ընթացքին։
Եղիշե Կիրակոսյանը նկատեց, որ նման որոշումներից հետո Հայաստանը պետք է լուրջ աշխատանք տանի դիվանագիտական ոլորտում։
Հիշեցնենք, որ Եվրոպական դատարանը բավարարեց Հայաստանի ներկայացրած պահանջը և միջանկյալ միջոցներ կիրառեց Ադրբեջանի նկատմամբ: Սույն թվականի դեկտեմբերի 21-ին Եվրոպական դատարանը ուսումնասիրել է ՀՀ կառավարության ներկայացրած` Ադրբեջանի նկատմամբ միջանկյալ միջոցներ կիրառելու պահանջը: Նշելով, որ այս պահին վիճելի է «Լաչինի միջանցքի» նկատմամբ Ադրբեջանի կողմից վերահսկողության առկայության հարցը, ինչպես նաև հաշվի առնելով 2020 թվականի նոյեմբերի 9-ի եռակողմ հայտարարության 6-րդ կետով Ադրբեջանի կողմից ստանձնած պարտավորությունները, մասնավորապես, «երաշխավորելու Լաչինի միջանցքով երկկողմ ուղղությամբ տեղաշարժվող անձանց, տրանսպորտային միջոցների և բեռների անվտանգությունը», և հիշեցնելով Եվրոպական կոնվենցիայով ստանձնած պարտավորությունները՝ Եվրոպական դատարանը որոշել է Դատարանի կանոնակարգի 39-րդ կանոնի հիման վրա պարտավորեցնել Ադրբեջանին ձեռնարկել բոլոր անհրաժեշտ և բավարար միջոցները՝ ապահովելու «Լաչինի միջանցքով» Հայաստանում բժշկական օգնություն ստանալու կարիք ունեցող ծանր հիվանդ անձանց տեղաշարժը, ինչպես նաև ճանապարհին անապաստան մնացած կամ ապրուստի միջոցների կարիք ունեցող անձանց անվտանգ տեղաշարժը:
Միաժամանակ, Եվրոպական դատարանը որոշել է առաջնահերթություն տալ Հայաստանի ներկայացրած թիվ 4 գանգատին՝ Դատարանի կանոնակարգի 41-րդ կանոնի համաձայն:
Հիշեցնենք, որ Հայաստանը ս.թ. դեկտեմբերի 15-ին, 16-ին, 20-ին և 21-ին միջանկյալ միջոց կիրառելու պահանջ և լրացուցիչ տեղեկատվություն էր ներկայացրել Եվրոպական դատարան՝ խնդրելով միջանկյալ միջոց կիրառել Ադրբեջանի նկատմամբ «Լաչինի միջանցքով» անցնող ճանապարհի արգելափակման հետևանքով քաղաքացիական բնակչության իրավունքների խախտումները վերացնելու համար:
