Վերաքննիչը երեք օրից կհրապարակի Ավետիք Չալաբյանի գործով որոշումը

«ԱՐԱՐ» հիմնադրամի համահիմնադիր, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի խափանման միջոցի բողոքարկման նիստի վճիռը հրապարակվելու է օգոստոսի 30-ին։
Վերաքննիչ քրեական դատարանում դատավոր Ռուզաննա Բարսեղյանի նախագահությամբ երեկ կայացել է Չալաբյանի փաստաբանների ներկայացրած վերաքննիչ բողոքի քննությունը։
Փաստաբանները նշել են, թե առաջին ատյանի դատավոր տխրահռչակ Մնացական Մարտիրոսյանն իր վրա է վերցրել Ազգային ժողովի գործառույթները և օրենքին հակասող վճիռ կայացրել։
Ավետիք Չալաբյանն իր հերթին նշել է, որ Մնացական Մարտիրոսյանն իրեն կալանավորելու պատրաստի վճռով էր եկել դատական նիստին։
«Նրան բացարձակ չեն հետաքրքրել ո՛չ մեղադրող կողմի, ո՛չ պաշտպանական կողմի փաստարկները, չկա որևէ պատճառաբանական հիմնավորում, չկա հղում փաստական հանգամանքներին, օրենքի դրույթներին», - ասել է Չալաբյանը:
Պաշտպանները նաև հիմնավորել են, որ քրեական գործ հարուցելու համար հիմք է հանդիսացել նախաքննության արդյունքում այդպես էլ չպարզված անհայտ աղբյուրից ստացված ապօրինի մի ձայնագրություն, որը հանդիսանում է օրենքով ձեռք բերված ապացույց և չի կարող դրվել մեղադրանքի հիմքում։
Ըստ էության, փաստաբանները արձանագրել են, որ չկա որևէ հիմք Ավետիք Չալաբյանին կալանքի տակ պահելու համար։ Իսկ պաշտպանական կողմը նշել է, որ կալանքից բացի ցանկացած այլ խափանման միջոց, որը կապ չունի ազատազրկման հետ, պատրաստ են ապահովել և կարող են նաև երաշխավորել Ավետիք Չալաբյանի պատշաճ վարքագիծը։
Դատարանը աշխատանքային օրվա ավարտի կապակցությամբ դատական նիստը հետաձգել է օգոստոսի 30-ին, այդ օրն էլ հրապարակելու է Չալաբյանին ազատ արձակելու վճիռը։
Վերաքննիչ քրեական դատարանը, նշենք, երեկ բավականին լուրջ ճնշման տակ էր գտնվում, դատավորը ստիպված էր լսել փաստաբանների բոլոր իրավական հիմնավորումները, արձանագրումները և իր «գործընկեր» դատավորի կողմից իրականացրած ապօրինությունների մասին բոլոր ապացույցները։
Փաստաբանական կողմը մեկ անգամ ևս արձանագրել է, որ Չալաբյանի դեպքում գոյություն ունի քաղաքական հետապնդում, և դատավորն իրականացնում է Նիկոլ Փաշինյանի տված հրահանգները։ Ակնկալենք, որ օգոստոսի 30-ին վերաքննիչ քրեական դատարանն ի վերջո արդարացի և ողջամիտ վճիռ կկայացնի՝ ազատ արձակելով Ավետիք Չալաբյանին։
