Շարունակվում է «Արար» հիմնադրամի համահիմնադիր, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի գործով դատաքննությունը։ Դատական այս գործընթացը հայտնվել է հասարակության լայն շերտերի ուշադրության կենտրոնում: Դատարանի դահլիճում, մամուլի ասուլիսների ու հարցազրույցների ժամանակ Ավ. Չալաբյանի պաշտպանական թիմը փաստական տվյալներ է ներկայացնում, որով ապացուցում է վերջինիս ներկայացված մեղադրանքի և կալանավորման հիմքում ընկած ապօրինությունները, բայց դատարանի դիրքորոշումը հստակ է՝ կալանավորման որոշումները հաջորդում են իրար: Ավ. Չալաբյանի պաշտպանական թիմի ներկայացուցիչ, փաստաբան Արմեն Անդրիկյանը նշում է՝պարոն Չալաբյանը քանիցս հայտարարել է, որ քաղաքական բանտարկյալ է՝ իր հասարակական-քաղաքական գործունեության պատճառով: «Կարծում եմ՝ կոնկրետ խնդիր է դրված, որպեսզի պարոն Չալաբյանը գտնվի կալանքի տակ: Մեզ համար հստակ է, որ այդ կալանքը պատիժ է: Պարոն Չալաբյանի նկատմամբ իր քաղաքական ու հասարակական գործունեության արդյունքում նշանակված է պատիժ՝ առանց մեղադրական դատավճռի»,-Past.am-ի հետ զրույցում ասում է Անդրիկյանը:

Ընդգծում է՝ կալանավորման պայմանն ու հիմքերն իսպառ բացակայում են: «Նշված հոդվածը, որով մեղադրվում է պարոն Չալաբյանը, մեր կարծիքով,  հակասահմանադրական է: Քրեական նոր օրենսգրքի փոփոխությունների ժամանակ, երբ օրենքն ընդունվում էր, դեռևս առաջին ընթերցման ժամանակ նշված հանցակազմն ընդհանրապես գոյություն չուներ: Հետո պարոն Չալաբյանին ձերբակալելուց և առաջին անգամ կալանավորելուց մի քանի օր հետո նշված հանցակազմն ավելացվում է Քրեական նոր օրենսգրքում: Այստեղից ենթադրություն ենք անում, որ դա հատուկ ավելացվել է պարոն Չալաբյանի համար: Ուսումնասիրել ենք նաև եվրոպական երկրների փորձը: Եվրոպական երկրների օրենսդրության մեջ իսպառ բացակայում է նյութապես շահագրգռելու եղանակով հավաքների ներգրավվելու հանցակազմը, այսինքն՝ տվյալ դեպքում նշված հանցակազմը եվրոպական երկրներում կարող է դրսևորվել բռնությամբ, շանտաժով, բռնության սպառնալիքով, բայց նյութապես շահագրգռելու գործոնն իսպառ բացակայում է: Այստեղ գործ ունենք հավաքների ազատության իրավունքի իրացման հետ: Եվրոպական երկրները նախատեսում են, որ նյութապես շահագրգռելը, օրինակ՝ ավտոբուսներ կամ ջուր տրամադրելը, որևէ կերպ չի կարող ազդել անձի՝ հավաքներին մասնակցելու իրավունքի իրացման վրա»,-նշում է մեր զրուցակիցը: Իհարկե, կալանավորումը չի կարող չանդրադառնալ անհատի հոգեվիճակի վրա:

 Փաստաբանից հետաքրքրվում ենք՝ ստեղծված իրավիճակում ինչպիսի՞ն է պարոն Չալաբյանի տրամադրվածությունն ու հոգեվիճակը: «Պարոն Չալաբյանը գիտակցում է իր բռնած ուղու ճիշտ լինելը, իր գործի արդարացի և ճիշտ լինելը և վստահ եմ, որ որևէ ճնշում չի կարող իրեն հետ պահել իր բռնած ուղուց»,-եզրափակում է Արմեն Անդրիկյանը:
