«Ավետիք Չալաբյանի կալանավորումն իրավաչափ չէ». Ռուբեն Մելիքյան

Օգոստոսի 3-ին «Արար» հիմնադրամի համահիմնադիր, հասարակական գործիչ Ավետիք Չալաբյանը երեք ամսով կալանավորվեց, թեև դատախազըհայտարարեց, որՉալաբյանինկատմամբբավարարէգրավիկիրառումը:
Իրավապաշտպան, «Իրավական ուղի» ՀԿ համահիմնադիր Ռուբեն Մելիքյանը, անդրադառնալով Չալաբյանի կալանավորմանը, Past.am-ի հետ զրույցում նշել է, որ նախ պետք է հստակ տարբերակել նախաքննության ու դատաքննության փուլերը:
«Նախաքննության փուլում դատարանն այդպիսի իրավունք չունի և չի էլ կարող ունենալ: Այսինքն՝ առանց դատախազի միջնորդության կալանք նշանակել: Դատաքննության փուլում դատարանն այդպիսի իրավունք ունի: Ընդ որում՝ ունեցել է Քրեական դատավարության ինչպես նախորդ, այնպես էլ ներկայիս օրենսգրքի պայմաններում՝ հաշվի առնելով այն հանգամանքը, որ այդտեղ հենց դատարանն է վարույթ իրականացնողը և հենց դատարանն է պատասխանատու վարույթի բնականոն ընթացքի, այդ թվում՝ ներգրավված անձանց պատշաճ վարքագիծն ապահովելու համար: Բայց որքան էլ դատարանն այդպիսի իրավունք ունենա, դա պետք է լինի շատ հազվադեպ: Սա նշանակում է, որ դրա համար պետք է այնքան ծանրակշիռ հիմավորումներ լինեն, որոնք անկողմնակալ դիտորդին կարող են համոզել, որ դա անհրաժեշտություն էր՝ անգամ եթե մեղադրանքի տերը, քրեական հետապնդման տերը հանդիսացող դատախազը նման անհրաժեշտություն չի տեսնում»,- ասաց մեր զրուցակիցը՝ շեշտելով, որ առանց լուրջ ու բացառիկ հիմնավորումներ ներկայացնելու նման որոշում կայացնելն իրավաչափ չէ:
«Դատարանի այս որոշումը ոչ իրավաչափ եմ համարում, որևէ պատշաճ բացատրություն չտրվեց դատարանի կողմից առ այն, թե ինչու է դատարանը գտնում, որ այդ հանգամանքներում անհրաժեշտ է կալանք կիրառել: Չմոռանանք նաև, որ Ավետիք Չալաբյանը մեղադրվում է միջին ծանրության արարքի համար: Եթե խոսքը չի վերաբերում ծանր հանցագործությանը, ապա իմ նշածն առավել ևս սուր բնույթ է կրում: Բնականաբար, այստեղ քաղաքական ենթատեքստ չտեսնելը դժվար է»,- հավելեց Ռ. Մելիքյանը:
Հիշեցնենք նաև, որ հուլիսի 27-ին Ավետիք Չալաբյանն ազատ էր: Ավելի վաղ «Համախմբում» շարժման անդամ Ավետիք Չալաբյանը ձերբակալվել էր 2022 թ. մայիսի 12-ին՝ Ագրարային համալսարանի ուսանողներին Հայաստանում քաղաքական ընդդիմության հավաքներին մասնակցության համար նյութապես շահագրգռելու կասկածանքով: Մայիսի 14-ին դատարանը նրան երկու ամսով կալանավորելու որոշում էր կայացրել:
