Աննախադեպ որոշում Հայաստանի իրավական պրակտիկայում․ Ավետիք Չալաբյանին կալանավորեցին

«ԱՐԱՐ» հիմնադրամի համահիմնադիր, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանը կրկին կալանավորվեց։ Տխրահռչակ դատավոր Մնացական Մարտիրոսյանը, ինչպես և կանխատեսում էին փաստաբանները, երեկ որոշում է կայացրել 3 ամսով կալանավորել Ավետիք Չալաբյանին։ Ընդ որում այդ կալանավորմանը դեմ էր նույնիսկ մեղադրող դատախազը, ով առաջարկել էր դատավորին գրավ կիրառել։
Չալաբյանի փաստաբանները նախ անձնական երաշխավորություն են ներկայացրել հանրային մեծ հեղինակություն վայելող անձանց կողմից, ապա և առաջարկել էին Չալաբյանի կալանքը փոխարինել գրավով։ Դատավորը, սակայն որոշեց կատարել ամենահրեշավոր արարքը և Ավետիք Չալաբյանին կրկին կալանավորեց։ Մինչդեռ ինքը՝ Ավետիք Չալաբյանը, նշել էր, որ առողջական լուրջ խնդիրներ ունի, և բժիշկը հանձնարարել էր նրան ամբուլատոր բուժում իրականացնել։ Չալաբյանը խոստացել էր ներկայանալ բոլոր դատական նիստերին՝ չբացառելով, որ նիստերի ժամանակ իր առողջական վիճակը կարող էր վատթարանալ։
Փաստենք, որ հերթական անգամ ինչպես և վայել է Մնացական Մարտիրոսյանին և նրան պատվերներ իջեցնող ապիկար ու դավաճան իշխանությանը, որևէ անկանխատեսելի բան տեղի չունեցավ։
Հուլիսի 27-ից ազատության մեջ գտնվող Ավետիք Չալաբյանը կրկին վերադառնալու է կալանավայր։ Սոցցանցերում արդարացիորեն հարց է հնչել, թե ո՞րն է Չալաբյանի նկատմամբ այս վերաբերմունքի պատճառը և ինչո՞ւ իշխանությունն ամեն գնով փորձում է կալանավորել նրան։ Նշում են, թե՛ Չալաբյանի փաստարկված քննադատությունը, թե՛ նաև «նախկիններ-ներկաներ» դիսկուրսից նրա դուրս գտնվելու, հետևաբար իշխանության համար քարոզչական առումով ավելի քիչ խոցելի լինելու հանգամանքը, ինչն էլ խելահեղության է հասցնում Նիկոլ Փաշինյանին և ստիպում ամենահակաօրինական մեթոդներին դիմել իր քաղաքական հիմնական ընդդիմախոսներից մեկին կալանքի տակ պահելու համար։
«Այս որոշումը աննախադեպ է Հայաստանի իրավական պրակտիկայում, թերևս հազվագյուտ դեպք է, երբ անձը կալանավորվում է հիմքերի լիակատար բացակայության, և օրենքի միարժեք պահանջների կոպիտ խախտման պայմաններում: Այս անհեթեթ գործողությունը ցույց է տալիս, թե որքան է գործող վարչախումբը սարսափում իր սկզբունքային ընդդիմախոսներից, և ինչ աղաղակող ապօրինությունների է այն պատրաստ գնալ՝ սեփական իշխանությունը երկարաձգելու նպատակով: Սակայն և ոչ մի ապօրինություն ի զորու չի շեղելու մեզ մեր նպատակից՝ կառուցելու ազատ ու հզոր երկիր, և արդար հասարակարգ բոլորիս համար: Մեր պայքարը շարունակվում է և միայն նոր թափ է ստանալու»,- նշել է Ավետիք Չալաբյանը։
