ՀՀ ԱԺ մարդու իրավունքների պաշտպանության և հանրային հարցերի մշտական հանձնաժողովի նախագահ, անկուսակցական Թագուհի Թովմասյանը գրում է

ՀՀ քաղաքացի Ժ. Մալոյանը «Հայաստան» խմբակցության քարտուղար Արծվիկ Մինասյանի ուղղորդմամբ ինձ է դիմել: Նա սպառնում էր անգամ ամենածայրահեղ քայլին դիմել՝ ինքնահրկիզվել, եթե չկարողանա ԱՄՆ մուտք գործել:
Իմ շտապ հանձնարարականով ԱԺ մարդու իրավունքների պաշտպանության և հանրային հարցերի մշտական հանձնաժողովի փորձագետները հանդիպել են ՀՀ քաղաքացի Ժ․ Մալոյանի հետ: Մոտ 2 ժամ լսել են քաղաքացուն, հստակեցրել ինձանից ունեցած ակնկալիքները։
 
Ըստ այդմ, անմիջապես պատրաստվել է գրություն ՀՀ-ում ԱՄՆ դեսպան Լին Թրեյսիին։ Նշել եմ, որ քաղաքացու պնդմամբ ինքը 6 գյուտերի հեղինակ է, որոնցից երկուսը համարվում են «դարի հայտնագործություն»։ Քաղաքացին հանդիպման ժամանակ փորձագետներին է ներկայացրել նաև ԱՄՆ համապատասխան օղակներից ստացված վկայագրերը՝ որպես ապացույցներ։
 
Ընտանեկան իրավիճակով պայմանավորված Հայաստան վերադառնալուց հետո քաղաքացին դժվարություններ է ունեցել պետական մարմինների հետ՝ իր ծրագրերի կենսագործման մասով։ Եվ ինչպես ինքն է պնդում, ունենալով երաշխավորություններ 2 ամերիկյան սենատորներից, որ ԱՄՆ-ում գտնվելու ժամանակ չի խախտել միգրացիոն օրենսդրությունը, որոշել է դիմել ՀՀ-ում ԱՄՆ դեսպանատուն ապաստանի համար, որպեսզի կարողանա հնարավորինս շուտ հասնել ԱՄՆ՝ օգտվելու իր գյուտերի ֆինանսավորման հնարավորություններից։
 
Քաղաքացին պնդում էր, որ հյուպատոսի հետ հանդիպմանն անվտանգության աշխատակիցը վերցրել է իր անձնագիրը և արել «Չեղարկված/Revoked» նշումը, որը փաստորեն խոչընդոտում է ԱՄՆ իր մեկնելուն։ Եվ այժմ Ժ. Մալոյանը խնդրում է աջակցել ԱՄՆ մեկնելու թույլտվության հարցում։
 
Սակայն ԱՄՆ դեսպանից ստացել եմ օպերատիվ արձագանք, համաձայն որի դեսպանն ի վիճակի չէ քննարկել իմ կողմից նշված գործի մանրամասները, քանի որ այն ԱՄՆ օրենքներով կարգավորվող հյուպատոսական իրավասության ներքո գտնվող հարց է:
Իրավասու օղակներից էլ տեղեկացա, որ նշված դեպքերում քաղաքացին պետք է անձամբ դիմում ներկայացնի հյուպատոսական ծառայությանը․ ես երրորդ անձ եմ համարվում։
Մալոյանը բարձրացրել է նաև քաղաքական ապաստանի թույլտվության վերաբերյալ հարցեր, որոնց կապակցությամբ Հանձնաժողովի փորձագետը տրամադրել է իրավաբանական խորհրդատվություն։
