ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչությունում ուսումնասիրվել է Երևան քաղաքի Հյուսիսային պողոտայի և կասկադի կառուցապատման ծրագրերի իրականացման գոտում հուշարձանների պահպանության՝ օրենսդրության պահանջներին համապատասխանության վիճակը: Հիմք են հանդիսացել «Թրանսփարենսի Ինթերնեշնլ հակակոռուպցիոն կենտրոն» ՀԿ-ից, ՀՀ դատախազության ստորաբաժանումներից, ՀՀ ԿԳՄՍ նախարարությունից, Երևանի քաղաքապետարանից, ՀՀ ԱՆ «Հայաստանի ազգային արխիվ» ՊՈԱԿ-ից ստացված փաստաթղթերը:

Այս մասին հայտնում է ՀՀ գլխավոր դատախազությունը։
Իրականացված ծավալուն ուսումնասիրությամբ պարզվել է, որ ՀՀ կառավարության 25.10.2000թ. թիվ 774 և 16.07.2001թ. թիվ 645 որոշումներով հաստատված Երևան քաղաքի Հյուսիսային պողոտայի և Կասկադի կառուցապատման ծրագրերի իրականացման գոտում առկա է եղել պետական հաշվառման վերցված ԽՍՀՄ, հանրապետական կամ տեղական նշանակության պատմության և մշակույթի թվով 19 անշարժ հուշարձան՝ Պուշկին, Արամի, Աբովյան, Թումանյան, Տերյան, Հին Երևանցու փողոցների տարբեր հասցեներում: Դրանք ընդգրկված են եղել Երևան քաղաքի պատմության և մշակույթի անշարժ հուշարձանների ցուցակներում, որոնցից մասնակիորեն պահպանվել է միայն Պուշկին փ. 25 հասցեում գտնվող հուշարձանը, իսկ մնացածը քանդվել են:


«Երևանի կառուցապատման ներդրումային ծրագրերի իրականացման գրասենյակ» ՀՈԱԿ-ից ստացված տեղեկության համաձայն՝ նշված հուշարձանների մի մասի վերաբերյալ տեղեկություն առկա չէ, իսկ որոշ հուշարձանների վերաբերյալ առկա տեղեկությունը թերի են:


Երևանի քաղաքապետարանից ստացված տեղեկության համաձայն՝ քաղաքապետարանի արխիվային նյութերում առկա են միայն 4 հուշարձանների քանդման թույլտվություններ, իսկ ՀՀ ԱՆ «Հայաստանի ազգային արխիվ» ՊՈԱԿ-ից ստացված տեղեկության համաձայն՝ հուշարձանների քանդման վերաբերյալ փաստաթղթեր Հայաստանի ազգային արխիվ չեն հանձնվել:


Այսինքն, 2000-2010թթ. ընթացքում Երևանի քաղաքապետարանի, ինչպես նաև մշակույթի նախարարության համապատասխան պաշտոնատար անձանց կողմից դրսևորվել է ծառայության նկատմամբ անբարեխիղճ կամ անփույթ վերաբերմունք, ինչի արդյունքում չեն կատարվել կամ ոչ պատշաճ են կատարվել հուշարձանների պահպանման և հսկողության իրականացման գործառույթները: Արդյունքում, Երևան քաղաքի Հյուսիսային պողոտայի և կասկադի կառուցապատման ծրագրերի իրականացման գոտում ամբողջությամբ քանդվել է 18 մշակութային հուշարձան, իսկ 1-ը պահպանվել է մասնակի: Ընդ որում՝ նշված հուշարձանների քանդման, վնասման վերաբերյալ նախապատրաստված նյութեր, հարուցված քրեական գործեր ևս չկան:


Նկատի ունենալով, որ ուսումնասիրությամբ ի հայտ են բերվել այնպիսի փաստական հանգամանքներ, որոնք պարունակում են արարքի կատարման պահին գործող՝ ՀՀ քրեական նախկին օրենսգրքով նախատեսված 315-րդ հոդվածով (գործող ՀՀ քրեական օրենսգրքի 446-րդ հոդվածի 1-ին մաս), ինչպես նաև նույն նախկին օրենսգրքի 264-րդ հոդվածի 1-ին մասով (գործող ՀՀ քրեական օրենսգրքի 301-րդ հոդվածի 1-ին մաս) նախատեսված առերևույթ հանցավոր արարքների հատկանիշների մասին տվյալներ՝ ուսումնասիրության արդյունքները հանցագործության կատարման մասին հաղորդմամբ ուղարկվել են ՀՀ քննչական կոմիտե՝ քրեական վարույթ նախաձեռնելու հարցը լուծելու հանձնարարությամբ:
