«ԱՐԱՐ» հիմնադրամի համահիմնադիր, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի շուրջ իրավական «բեսպրեդել»-ը շարունակվում է։

Նախօրեին Քննչական կոմիտեն պաշտոնական հաղորդագրություն էր տարածել Ավետիք Չալաբյանի գործի նախաքննության ավարտի և այն դատախազին փոխանցելու վերաբերյալ։ Չալաբյանի փաստաբանների խոսքով, սա հնարավորություն էր պաշտպանական խմբի համար՝ չկաշկանդվելով նախաքննության փուլի գաղտնիության պահանջից, հանրությանը հանգամանորեն ներկայացնել Ավետիք Չալաբյանին մեղսագրվող արարքի անհեթեթությունը, սին ու շինծու բնույթը, ինչպես նաև դատավարական դռնբաց նիստերի միջոցով ապացուցել Ավետիք Չալաբյանի անմեղությունը։

Երեկ հայտնի դարձավ, որ դատավարական ղեկավարում իրականացնող դատախազը չի հաստատել Ավետիք Չալաբյանի գործի մեղադրական եզրակացությունը, վարույթի նյութերը վերադարձրել է նախաքննական մարմին՝ նախաքննությունը շարունակելու ցուցումով, և հապճեպ կարգով միջնորդություն է ներկայացվել դատարան Ավետիք Չալաբյանի կալանավորումը երկարացնելու համար։

Ուշ երեկոյան պետք է կայանար Չալաբյանի կալանքը երկարացնելու վերաբերյալ դատական նիստը, նրա փաստաբանները ներկայացել էին նիստին, սակայն վարույթն իրականացնող մարմինը պատշաճ չէր ներկայացել։

Ըստ փաստաբանների՝ վարույթն իրականացնող մարմինը կալանքի ժամկետը մեկ ամսով երկարացնելու համար դատարան միջնորդություն ներկայացնելով, խախտել է քրեադատավարական բոլոր ընթացակարգերը։

«Այս խայտառակ վիճակը չվրիպեց ո՛չ մեր, ո՛չ էլ դատարանի աչքից, ինչի մասին բարձրաձայնվեց»,- ասել է փաստաբան Արթուր Հարությունյանը։

Քննիչը նախ միջնորդել է դատական նիստը մեկ, ապա երկու ժամով հետաձգելու մասին, և դատարանը ի հեճուկս պաշտպանների առարկության, որոշել է նիստը հետաձգել, այն կկայանա այսօր կեսօրին։

Ըստ ամենայնի նախաքննական մարմինը դատախազության կողմից ապտակ ստանալուց հետո, այժմ էլ նոր մեթոդներ է փորձելու գտնել Ավետիք Չալաբյանի կալանավորումը երկարաձգելու համար։ Իսկ այս գործով ընթացող քննությունը վաղուց արդեն սպառնում է դառնալ Հայաստանի իրավագիտության պատմության ամենաանհեթեթ և անիմաստ գործերից մեկը։ Իսկ մինչ այդ «ԱՐԱՐ» հիմնադրամի համահիմնադիրը շարունակում է մնալ կալանքի տակ։
