Իրավական կազուս Ավետիք Չալաբյանի գործով

«ԱՐԱՐ» հիմնադրամի համահիմնադիր, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի գործով իրավական կազուսը շարունակվում է։ Չալաբյանի կալանքի ժամկետը ավարտվում է հուլիսի 12-ին, և դատարանը պետք է մինչ այդ օրը քննի նրա կալանքը երկարաձգելու կամ կալանքից ազատելու որոշումը։ Մինչդեռ վերաքննիչ քրեական դատարանի դատավոր Արմեն Շիրոյանը օրեր առաջ Ավետիք Չալաբյանի խափանման միջոցը փոփոխելու համար ներկայացված միջնորդությունների քննության նիստը հետաձգեց ՝ նշանակելով հունիսի 27-ին, տարակուսանքի մեջ թողնելով Չալաբյանի պաշտպաններին և իրավաբաններին։
Հիշեցնենք՝ հուլիսի 1-ից պետք է Չալաբյանն ազատության մեջ լիներ, քանի որ քրեական օրենսգրքի 163-րդ հոդվածով նախատեսված հանցակազմը ապաքրեականացվել էր, սակայն նրան մեկ այլ հոդվածով մեղադրանք են առաջադրել, իսկ օրենքի տվյալ կետը լրացրել էին՝ այդ հարցով նույնիսկ խորհրդարանում քննարկում կամ հանրային լսում չանելով։
Անկախ ամեն ինչից, իշխանությունները ստիպված են լինելու մինչև հուլիսի 12-ը ևս մեկ դատական նիստ գումարել, որպեսզի քննարկեն երկամսյա կալանքը։ Մեր տեղեկություններով, նախաքննական մարմինը մտադիր է անպայման հասնել Չալաբյանի կալանքը ևս 2 ամսով երկարաձգելուն, նախքան գործը դատարան ուղարկելը։
Ընդ որում ինչպես ցույց է տալիս նման դեպքերի պրակտիկան, իշխանությունները մտադիր են կալանքի ժամկետը 2-ական ամսով ձգձգելով հնարավորինս երկար պահել Ավետիք Չալաբյանին, իսկ քրեական գործերը դատարան հնարավորինս ուշ ուղարկել՝ հստակ գիտակցելով, որ այդ գործը որևէ շանս չի կարող ունենալ նույնիսկ իշխանության ամենամոլեռանդ պաշտպան դատավորների կողմից քննվելու դեպքում։ Այս ամենին նաև նպաստում են ընդդիմության գործողությունները։
Չի բացառվում, որ ընդդիմությունը կարող էր ակտիվանալ առավելագույնը աշնանը, իսկ մինչև այդ, ամռանը ավելի շատ լճացման փուլ է լինելու, և իշխանությունները չեն ցանկանում կորցնել այս ժամանակը։ Ազգային ժողովը շաբաթական մի քանի արտահերթ նիստ է անելու իրենց ներկայացրած բոլոր օրենքները փոփոխելու համար։ Այդ ընթացքում էլ փորձելու են հնարավորինս թուլացնել ընդդիմությանը, նեղել, շատերին ձերբակալել կամ կալանավորել, շատերին բռնաճնշումների ենթարկել, հնարավորության դեպքում էլ պառակտել դիմադրության շարժումը։ Իսկ Ավետիք Չալաբյանն ու մյուս քաղբանտարկյալները շարունակելու են մնալ անազատության մեջ։
