Մոտ օրերս Չալաբյանի խափանման միջոցի փոփոխության հարցը կարող է լուծվել

Ավետիք Չալաբյանի փաստաբանական խումբը հայտնել էր, որ հասարակական-քաղաքական գործիչը իրավունքի ուժով պետք է ազատության մեջ լինի ամենաուշը հուլիսի մեկին: Այսօր հուլիսի մեկն է, բայց Չալաբյանը շարունակում է մնալ անազատության մեջ:

1or.am-ը Չալաբյանի փաստաբան Արթուր Հարությունյանի հետ զրույցում փորձել է պարզել պատճառները.

«Ի սկզբանե, երբ 2021 թվականին ընդունվել էր Քրեական նոր օրենսգիրքը, այդ հոդվածը՝ նյութապես շահագրգռելու բաղադրիչով, որպես այդպիսին գոյություն չուներ, և մինչև անցած ամիս այդպես էլ գնում էր, որ այդպես էլ մնալու է և հուլիսի 1-ից, քանի որ հանցակազմը այլևս քրեական չի լինելու, բնականաբար պետք է քրեական հետապնդումը դադարեցվեր։ Սակայն մենք իմանում ենք, որ գաղտնի, բոլոր ընթացակարգերի ոտնահարմամբ իրականացվել է օրենքում լրացում, փոփոխություն կատարելու մասին գործընթաց, նոր քրեական օրեսնգրքի (դեռևս ուժի մեջ չմտած) մեջ և կրկին ավելացվում է նյութապես շահագրգռելու մասին բաղադրիչը։ Դրա մասին մենք մոտ երկու-երեք շաբաթ առաջ բարձրաձայնել ենք, որ գաղտնի օրենք է տարվել առանց ընթացակարգերի քննարկման և պետաիրավական հանձնաժողովի եզրակացության, այդպես անօրինական ճանապարհով արագ անց են կացրել և կրկին քրեականացվել է։

Այստեղ որակումների մեջ ամեն դեպքում տարբերություններ կան։ Տարբերությունը կայանում է հետևյալում՝ արդեն ուժը կորցրած նախկին Քրեական օրենսգրքով 163-րդ հոդվածի 2-րդ մասի 3-րդ կետը, որով մեղադրանք է առաջադրվել մեր պաշտպանյալին, որակյալ մաս է որպես այդպիսին՝ երկու և ավելի անձանց նկատմամբ նյութական շահագրգռության փաստը։ Նոր օրենսգրքով որակյալ հոդված որպես այդպիսին չկա (երկու և ավելի անձանց ֆակտորը չկա)։ Ստացվում է, որ ոչ ամբողջությամբ , բայց այս ձևակերպումներով փաստացի մասնակի ապաքրեականացում եղել է։ Այս ձևակերպմամբ էլ, որ նայում ենք, օրենսդրի կողմից այն արարքը, որով քրեական հետապնդման է ենթարկվում մեր պաշտպանյալը, հանրային վտանագավորության աստիճանը ավելի նվազ է դիտարկվում։ Այս պահին Ավետիք Չալաբյանի պաշտպանական թիմը բազմաթիվ միջնորդություններ, դիրքորոշումներ և իրավական այլ ընթացակարգերով գործընթաց է սկսել, որպեսզի պարոն Չալաբյանի խափանման միջոցի հարցը հուլիսի 1-ով նոր ուժի մեջ մտած քրեական օրենսգրքով և քրեական դատավարության օրենսգրքով ևս մեկ անգամ քննարկման առարկա դառնա և լուծվի»։

Փաստաբանի խոսքով՝ Չալաբյանի խափանման միջոցի հարցը կարող է լուծվել մինչև հուլիսի 21-ը, նշանակված է խափանման միջոցը փոփոխելու համար ներկայացված միջնորդությունների քննության նիստը.

«Մինչև հուլիսի 21-ը մենք ևս մեկ բողոք ունենք ներկայացրած վերաքննիչ դատարանին, և մոտ օրերս, եթե որևէ բան չփոխվի, պետք է նիստ նշանակվի: Խոսքը մեր պաշտպանական թիմի կողմից դեռևս անցած ամիս ներկայացված միջնորդության մասին է, որպեսզի նոր հանգամանքների ի հայտ գալու փաստով դատարանը թույլատրի պարոն Չալաբյանի խափանման միջոցի փոփոխությունը: Մեզ համար անհասկանալի պատճառներով և առանց որևէ իրավական հիմնավորման, դատարանը մերժեց մեր միջնորդությունը, և մենք բողոք ներկայացրեցինք: Եթե ողջամտության սահմաններում գտնվենք, միանշանակ պետք է նիստը նշանակվի մինչև 21-ը, և այդ նիստով ևս կարող է խափանման միջոցի փոփոխության հարցը լուծվել, բնականաբար, բողոքը բավարարելու դեպքում»:
