Ավետիք Չալաբյանին փակի տակ պահելու համար գաղտնի փոխել են օրենքը

Այսօր հուլիսի 1-ն, է և «ԱՐԱՐ» հիմնադրամի համահիմնադիր, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանը պետք է լիներ ազատության մեջ, սակայն նրան ամեն գնով անազատության մեջ պահելու մոլուցքով տառապող իշխանությունը, իրավական այնպիսի շիլաշփոթ է ստեղծել, որ նույնիսկ մասնագետ իրավաբանների համար հասկանալի չէ, թե ինչ է կատարվել։ Չալաբյանն, իհարկե, կմնա անազատության մեջ։

Բանն այն է, որ քրեական օրենսգրքով Ավետիք Չալաբյանին առաջադրված 163-րդ հոդվածը ապաքրեականացվել էր, և հուլիսի 1-ից ուժի մեջ մտնող հանգամանքներով Ավետիք Չալաբյանը պետք է լիներ ազատության մեջ։

Հընթացս պարզվում է, որ նրան այլ հոդվածով են մեղադրանք առաջադրել՝ քրեական օրենսգրքի 236-րդ հոդվածով, իսկ հավաքին մասնակցելուն հարկադրելու հանցակազմը լրացվել է նաև նյութապես շահագրգռելու հանցակազմով։ Թե ինչպե՞ս և ի՞նչ հանգամանքներում է լրացվել 236-րդ հոդվածը, որևէ մեկը, այդ թվում Ավետիք Չալաբյանի փաստաբանական թիմը տեղյակ չէ։

Ո՛չ լսումներ են կազմակերպվել, ո՛չ որևէ կերպ Ազգային ժողովում քննարկման է դրվել, ընդսմին ցույց են տալիս թուղթ, որում գրված է այն, ինչ ցանկանում է իշխանությունը և այդ թղթի հիման վրա Չալաբյանին պահում ճաղերի ետևում։ Ասել, թե սա նենգափոխում է փաշինյանական իշխանությունների կողմից, առնվազն մեղմասացություն կլինի։

Ի սկզբանե մենք նշել էինք, որ գործող իշխանություններն ամեն ինչ անում են Ավետիք Չալաբյանին անազատության մեջ պահելու համար, թե՛ հարուցված քրեական գործը առանց Չալաբյանի իմացության ձայնագրությունը, որը որևէ կերպ հնարավոր չէ որպես ապացույց գործում ներգրավելուն, թե՛ իրականացվող ամբողջ իրավական «բեսպրեդելը» վկայում են, որ իշխանությունները բացարձակապես թքած ունեն օրենքի և օրինականության վրա։ Նրանք հստակ իրենց առջև նպատակ են դրել Չալաբյանին պահել ճաղերի ետևում։

Միջազգային կառույցներն ու տեղական իրավապաշտպանները որևէ ծպտուն չեն հանում, բացառությամբ, թերևս, Արման Թաթոյանի։

Մայիսի կեսերից կալանքի տակ գտնվող Չալաբյանն, իհարկե, դիմանում է մեկուսարանում, գրքեր է կարդում, հոդվածներ է գրում, Հայաստանի զարգացման իր տեսլականն է ներկայացնում:

Ընտանիքն է նեղվում ստեղծված իրավիճակից, երեխաները մեկուկես ամիս չեն տեսել իրենց հորը, միայն ավագ որդին է օրեր առաջ մոր հետ այցելել և հանդիպել նրան։ Այս ամենը վկայում է, որ գործող իշխանությունները թքած ունեն ոչ միայն օրենքի, այլ նաև մարդկային տարրական բարոյականության վրա։ Ավետիք Չալաբյանին փորձում են նեղել, ճնշումների ենթարկել՝ ընտանիքից հեռու պահելով, հանիրավի ազատազրկված պահելով։

Վստահ ենք, որ Չալաբյանը կլինի ազատության մեջ, կգրկի իր ընտանիքի անդամներին և նույն եռանդով կշարունակի պայքարել հանուն Հայաստանի Հանրապետության։
