Ավետիք Չալաբյանի գործով իրավական «բեսպրեդելը» շարունակվում է

Հայաստանի գլխավոր դատախազությունը մերժել է «ԱՐԱՐ» հիմնադրամի համահիմնադիր, հասարակական-քաղաքական գործիչ Ավետիք Չալաբյանի խափանման միջոց կալանքը փոխելու պատգամավորների երաշխավորության դիմումը։ Դեռևս մայիսի 25-ին Չալաբյանի նկատմամբ կիրառված խափանման միջոցի փոփոխության վերաբերյալ երաշխավորություններով գլխավոր դատախազին դիմել են պատգամավորներ Սեյրան Օհանյանը, Իշխան Սաղաթելյանը, Էլինար Վարդանյանը, Հայկ Մամիջանյանը, Տիգրան Աբրահամյանը, նաև նախկին փոխվարչապետ Վաչե Գաբրիելյանը և «ԱՐԱՐ» հիմնադրամը։
Շուրջ 20 օր քննելով այս երաշխավորությունները՝ ի վերջո գլխավոր դատախազությունը պատասխանել է փաստաբաններին, նշել, որ մերժում է պատգամավորների և հանրության մեջ մեծ հեղինակություն վայելող անձանց երաշխավորությունները։
«Դատախազը, անտեսելով երաշխավորությունների ինստիտուտի օրենսդրական չափանիշը, որի որոշման հիմքում պետք է դնի երաշխավորություն տրամադրող անձի վստահելու հանգամանքը, պարզապես նշել է, որ նախաքննության ներկա փուլում չեն վերացել և պահպանվել են մեղադրյալ Չալաբյանին կալանքի տակ պահելու հիմքերը։ Դատախազի եզրահանգումը ուղիղ հակադրվում է երաշխավորության ինստիտուտի օրենսդրական նշանակությանը», ասվում է պաշտպանների հայտարարության մեջ, փաստաբանները նաև նշել են, որ դատախազության որոշումը բողոքարկելու են դատական կարգով։
Ըստ էության, դատախազության այս որոշումը մեկ անգամ ևս ապացուցում է, որ Հայաստանում գործող իշխանության պայմաններում քաղաքական գործերով քրեական արդարադատության ներպետական մեխանիզմներն անարդյունավետ են և գործում են բացառապես ըստ քաղաքական նպատակահարմարությունների։
Ավետիք Չալաբյանը ձերբակալվել է, ապա և կալանավորվել է ընդամենը մեկ մարդու՝ Ագրարային համալսարանի ուսանողական խորհրդի նախագահ Թոռնիկ Ալիյանի տված կեղծ ցուցմունքի հիման վրա։ Գործող վարչախումբը՝ Նիկոլ Փաշինյանի գլխավորությամբ, ամեն ինչ անում է հանրային մեծ վստահություն և հեղինակություն վայելող Ավետիք Չալաբյանին հանիրավի անազատության մեջ պահելու, նրան երկրում ընթացող իրադարձություններից հեռու պահելու համար։ Իսկ իրավապահ մարմինները, դատախազությունն ու դատարանները դարձել են Նիկոլ Փաշինյանի ձեռքի խամաճիկը և վաղուց հեռացել արդարադատություն իրականացնելու իրենց բուն առաքելությունից։
