«Փաստ» օրաթերթը գրում է

Տարածքային կառավարման և ենթակառուցվածքների նախարարությունը հանրային քննարկման է ներկայացրել նախագիծ, որով առաջարկվում է լրացում կատարել «Պատմության և մշակույթի անշարժ հուշարձանների ու պատմական միջավայրի պահպանության և օգտագործման մասին» օրենքում, որի 21-րդ հոդվածն արգելում է հուշարձանների քանդումը:

Նշվում է, որ հանրապետական և տեղական նշանակության հուշարձանի ամբողջական կամ մասնակի տեղափոխումը կարող է կատարվել միայն բացառիկ դեպքում, եթե հուշարձանի նյութական պահպանությունը հրամայաբար պահանջում է այն տեղափոխել, ինչը կատարվում է Կառավարության թույլտվությամբ: Հուշարձանի փոփոխումը կատարվում է բացառիկ` նրա սկզբնական ու հարմարեցված գործառնական նշանակությամբ օգտագործելու անհնարինության և (կամ) շահագործման նորմատիվային պահանջներին համապատասխանեցնելու դեպքերում: Գործող իրավակարգավորումների շրջանակում հուշարձանի տեղափոխումը կարող է իրականացվել միայն նյութական պահպանության հետ կապված խնդրի դեպքում, ինչը հնարավորություն չի ընձեռում հուշարձանի տեղափոխման գործընթացն իրականացնել այլ հիմքերով, այն է՝ դիտելիության ապահովման, պատշաճ խնամքի կազմակերպման և այլն: Մինչդեռ, հուշարձանի տեղափոխման անհրաժեշտություն և պահանջ կարող է առաջանալ նաև այլ հիմքերով:

Օրինակ՝ Կառավարության 2004 թ.-ի հոկտեմբերի 7-ի N 1616-Ն որոշմամբ՝ Երևան քաղաքի պատմության և մշակույթի անշարժ հուշարձանների պետական ցուցակում ընդգրկված տեղական նշանակության «Վահագն Վիշապաքաղ» հուշարձանը ցանկապատված տարածքում է (Վաղարշյան 12 շենքին հարող տարածք)՝ շրջափակված տարատեսակ շինություններով, ինչը խաթարում է հուշարձանի տեսողական ընկալումը: Հաշվի առնելով այս հարցերը` առաջարկվում է որպես հուշարձանի տեղափոխման բացառիկ դեպք, ի թիվս նյութական պահպանության պահանջի, ամրագրել նաև հուշարձանի բարենպաստ տեսողական ընկալման ապահովման անհրաժեշտությունը և պատշաճ խնամքի կազմակերպումը:
