«Փաստ» օրաթերթը գրում է

Ինչպես հայտնի է, արդարադատության նախարարության կողմից ներկայացված օրենքի նախագծով առաջարկվում էր սահմանել դատավորի անհամատեղելիության պահանջների խախտման (կամ այլ կերպ ասած՝ լիազորությունների դադարեցման) նոր հիմք՝ կապված միջազգային դատարանի որոշման հետ: Եթե ավելի պարզ լեզվով ներկայացվի այս ամենը, իշխանությունները նմանօրինակ կարգավորումներով փորձում են դատական համակարգում իբր «վեթինգ» իրականացնել, իսկ իրականում ստանալ նոր գործիքակազմ՝ ազատվելու Փաշինյանի քաղաքական քմահաճույքները չբավարարող դատավորներից։ Մասնագետներն արդեն իսկ այս առաջարկը ևս որակել են որպես դատական իշխանության անկախությունը վտանգող:

Բոլորովին վերջերս հայտնի դարձավ, որ Վենետիկի հանձնաժողովը դատական համակարգի «վեթինգին» ուղղված այդ նախագծի վերաբերյալ իր կարծիքում ոչ միայն հստակորեն արձանագրել էր, որ չկա նման կարգավորումների անհրաժեշտություն, այլև կոնկրետ ընդգծել էր նախագծում առկա մի շարք տարրական իրավաբանական սխալներ։

«Փաստ» թերթի հետ զրույցում իրավաբանական հանրույթի ներկայացուցիչներից մեկը նշել է, որ իրականում ԱՆ-ն ուղղակի աչք է փակել Վենետիկի հանձնաժողովի առանցքային դիտարկումների վրա։

Բանն այն է, որ իշխանությունները փորձել են ամեն ինչ անել՝ կարգավորումներն այնպես համադրելու, որ օրենքի այդ փոփոխությունը հետադարձ ուժ ունենա, այնինչ, Սահմանադրության համաձայն, անձի իրավական վիճակը վատթարացնող օրենքները և այլ իրավական ակտերը հետադարձ ուժ չեն կարող ունենալ, ավելին՝ Վենետիկի հանձնաժողովը պնդել է, որ հետադարձ ուժը պետք է լիովին բացառել։

Թերթի տեղեկություններով, ներկայումս իշխանություններն ամեն ինչ անում են, որպեսզի այս օրինագիծն իրենց ցանկալի փաթեթավորմամբ կյանքի կոչվի հատկապես այս շրջափուլում, երբ միջազգային հանրության ու կառույցների ուշադրությունը կենտրոնացած է աշխարհաքաղաքական այլ իրադարձությունների վրա։
