Վարչապետը որոշ դեպքերում կկարողանա համայնքապետի ԺՊ նշանակել. ԱԺ-ն առաջին ընթերցմամբ ընդունեց նախագիծը
POLITICS«Քաղաքացիական պայմանագիր» խմբակցության պատգամավորներն առաջարկում են Տեղական ինքնակառավարման մասին օրենքում լրացումներ կատարել, ինչի արդյունքում կլուծվի խոշորացված համայնքների ՏԻՄ կառավարման խնդիրը:
Ինչպես տեղեկացնում է «Արմենպրես»-ը, նախագծի հեղինակներն են «Քաղաքացիական պայմանագիր» խմբակցության պատգամավորներ Վահագն Հովակիմյանը, Վլադիմիր Վարդանյանը և Արփինե Դավոյանը:
Վահագն Հովակիմյանը ներկայացրեց, թե ինչու է անհրաժեշտություն առաջացել նախագիծը հրատապ ռեժիմով քննարկել:
«ՏԻՄ ընտրությունների արդյունքում ստեղծվել է մի իրավիճակ, որ որոշ համայնքներում ՏԻՄ կառավարման բնականոն ընթացքը խաթարվել է, և այս օրենսդրական նախաձեռնության հրատապությունը դրանով է պայմանավորված, որպեսզի այն համայնքներում, որտեղ նման խնդիր է ստեղծվել, ՏԻՄ կառավարումը բնականոն շարունակվի և քաղաքացիների սպասարկումը վերականգնվի»,- ասաց Հովակիմյանը:
«Հայաստան» խմբակցության քարտուղար Արծվիկ Մինասյանը հետաքրքրվեց, թե ո՞ր համայնքներին է վերաբերվում խնդիրը, որ հրատապության խնդիր է առաջացել:
Հովակիմյանը հարցին ի պատասխան ասաց, որ այս պահն նման խնդիր կա Վանաձոր համայնքում:
«Այնտեղ ավագանու առաջին նիստը դատարանի որոշմամբ ուղղակի արգելվել է: Դատարանը արգելել է այդ նիստը գումարել մինչև դատական ակտի կայացումը ու դա, ըստ էության, մինչև հուլիս շարունակվելու է: Ստեղծվել է մի վիճակ, որ նորընտիր ավագանին իր կամքից անկախ չի կարող նիստ գումարել և համայնքի բնականոն գործունեությունը խաթարված է»,- ասաց Հովակիմյանը:
Հովակիմյանը շեշտեց` խորհրդարանի պարտականությունն է իր լիազորությունների շրջանակներում ապահովել Հայաստանի Հանրապետության ողջ տարածքում բնականոն կյանքը:
«Եթե կա որևէ օրենսդրական բաց, որի հետևանքով Հայաստանի Հանրապետության որևէ համայնքում խնդիր է առաջանում և այդ խնդիրը օրենսդրական մակարդակում է, խորհրդարանը պարտավոր է այդ խնդիրը լուծել: Սա մեր պարտականությունն է»,- ընդգծեց Հովակիմյանը:
Նախագծով առաջարկվում է «Տեղական ինքնակառավարման մասին» օրենքի 102-րդ անցումային դրույթում ավելացնել 6-րդ մաս հետևյալ բովանդակությամբ. եթե օրենքով միավորված համայնքի ավագանու առաջին նիստն ավագանու լիազորությունները ստանձնելու պահից քսան օրվա ընթացքում չի գումարվում կամ «Տեղական ինքնակառավարման մասին» օրենքի 69-րդ հոդվածի 2-րդ մասով սահմանված կարգով այդ ավագանու լիազորությունները վաղաժամկետ դադարեցվում են, ապա Հայաստանի Հանրապետության վարչապետը նշանակում է համայնքի ղեկավարի պաշտոնակատար մինչեւ օրենքով սահմանված կարգով նորընտիր համայնքի ղեկավարի լիազորությունների ստանձնումը:
«Սա փաստում է այն հանգամանքը, որ այս գործիքը կարող է կիրառվել միայն խոշորացվող համայնքների դեպքում: Այլ կերպ ասած, սա ընդհանուր դրույթների և ընդհանուր կարգավորումների մեջ չի»,- ասաց Հովակիմյանը:
Խորհրդարանն առաջին ընթերցմամբ ընդունեց առաջարկված օրինագիծը: Օրինագծին կողմ քվեարկեց 57, դեմ՝ 4 պատգամավոր:
