«Փաստ» օրաթերթը գրում է
Տարածքային կառավարման և ենթակառուցվածքների նախարարությունը հանրային քննարկման է ներկայացրել նախագիծ, որով առաջարկվում է ուժը կորցրած ճանաչել «Իրավունք հաստատող փաստաթղթերը չպահպանված անհատական բնակելի տների կարգավիճակի մասին» 2008 թ.-ի հունիսի 10-ի ՀՕ-117-Ն օրենքը: Նախագիծը մշակել է Երևանի քաղաքապետարանը:
Նշվում է` այս օրենքի 2-րդ հոդվածի համաձայն՝ ՀՀ համայնքների վարչական տարածքներում մինչև 2001 թ.-ի մայիսի 15-ը տիրապետվող և նույն օրենքի ուժի մեջ մտնելու պահին առկա (ներառյալ` հանրության գերակա շահ ճանաչված տարածքներում), քաղաքացիներին պատկանող՝ բնակելի տան կառուցման և սպասարկման համար օրինական հողամասերին կից ավել օգտագործվող մինչև 300 քառակուսի մետր սահմանազատված պետական կամ համայնքային սեփականություն հանդիսացող հողամասերը, դրանց վրա կառուցված բնակելի տները, բնակելի նշանակության օժանդակ շինությունները, եթե դրանք կառուցված չեն կամ չեն գտնվում ՀՀ հողային օրենսգրքի 60-րդ հոդվածով սահմանված հողամասերի, այդ թվում` ինժեներատրանսպորտային օբյեկտների օտարման գոտիներում, չեն հակասում քաղաքաշինական նորմերին, չեն առաջացնում սերվիտուտ, ապա նույն օրենքի ուժով համարվում են այն ֆիզիկական անձի կամ անձանց սեփականությունը, որի սեփականությունը համարվող հողամասին կից է գտնվում ավել օգտագործվող հողամասը կամ շինությունը, և ով տիրապետում է այդ գույքը` որպես սեփական գույք: 2021 թ.-ի դեկտեմբերի 16-ի ՀՕ-397-Ն օրենքով լրացումներ և փոփոխություններ են կատարվել ՀՀ քաղաքացիական օրենսգրքում:
Օրենսգրքի 188-րդ հոդվածը լրացվել է 1.1-ին մասով, որի համաձայն՝ ինքնակամ կառույցը չի կարող ճանաչվել օրինական և ենթակա է քանդման: Նման կառույցի քանդման (ապամոնտաժման) կարգը և ժամկետները սահմանվում է կառավարության որոշմամբ: Օրենքն ուժի մեջ մտնելուց հետո արդեն իսկ արգելվում է, առանց օրենսդրությամբ սահմանված կարգով տրված թույլտվության, ինքնակամ կառույցների օրինականացումը, և դրանք ենթակա են քանդման: Նշվում է՝ այս օրենքի ընդունումը կբացառի փաստացի ապօրինի գործողություն կատարած քաղաքացիների համար հողամասերի և ինքնակամ շինությունների նկատմամբ սեփականության իրավունքն անվճար ձևակերպելու հնարավորությունը:
Իսկ նպատակը պետական և համայնքային սեփականություն հողամասերի զավթման և դրանց, ինչպես նաև ֆիզիկական և իրավաբանական անձանց սեփականության իրավունքով պատկանող հողամասերի վրա ինքնակամ շինությունների կառուցման կանխարգելումն է:
