Արցախի ԱԺ-ն առաջին ընթերցմամբ միաձայն ընդունեց «Բռնազավթված տարածքների մասին» օրենքը

Արցախի Ազգային ժողովն առաջին ընթերցմամբ միաձայն ընդունեց «Բռնազավթված տարածքների մասին» և «Քաղաքացիական օրենսգրքում լրացում կատարելու մասին» օրենքների նախագծերի փաթեթը:

Նախագծերի փաթեթին կողմ քվեարկեցին նիստին ներկա բոլոր 31 պատգամավորները:

Օրենքի նախագիծը սահմանում է 1991-1994 և 2016 թվականներին Ադրբեջանի Հանրապետության և 2020 թվականին Թուրքիայի Հանրապետության և օտարերկրյա զինյալ ահաբեկիչների անմիջական մասնակցությամբ Ադրբեջանի Հանրապետության կողմից Արցախի Հանրապետության դեմ իրականացված ռազմական ագրեսիայի հետևանքով բռնազավթված տարածքների իրավական կարգավիճակի ու դրանց վրա տարածվող իրավական հատուկ ռեժիմի,  պետական կառավարման և տեղական ինքնակառավարման մարմինների, կազմակերպությունների գործունեության առանձնահատկությունների, մարդու և քաղաքացու իրավունքների և ազատությունների, ինչպես նաև իրավաբանական անձանց իրավունքների և շահերի պահպանության ու պաշտպանության հետ կապված հարաբերությունները:

Պատգամավորն օրենսդիր մարմնին առաջարկեց օրենքի նախագիծն ընդունել առաջին ընթերցմամբ:

Օրենքի նախագծով բռնազավթված տարածքներ են համարվում` Ադրբեջանի Հանրապետության վերահսկողության տակ գտնվող` «Լեռնային Ղարաբաղի Հանրապետության վարչատարածքային բաժանման մասին» օրենքում *-ով, **-ով և ***-ով նշված շրջանները, համայնքները և բնակավայրերը, ինչպես նաև այդ շրջանների տարածքում ընդգրկված հողերը և ջրային ռեսուրսները:

Հանրապետության կողմից  1991-1994  թվականների պատերազմական 

գործողությունների հետևանքով, իսկ **-ով և ***-ով նշված բնակավայրերը բռնազավթված են Ադրբեջանի Հանրապետության կողմից 2020 թվականի սեպտեմբերի 27-ին Արցախի Հանրապետության դեմ սանձազերծված պատերազմական գործողությունների հետևանքով:

Նախագծում նշվում է, որ բռնազավթված տարածքներում օտարերկրյա անձանց մուտքը, ելքը և  տեղաշարժը թույլատրվում է միայն Արցախի Հանրապետության օրենսդրությամբ սահմանված կարգով։ Այդ կարգի խախտումն առաջացնում է Արցախի Հանրապետության օրենսդրությամբ սահմանված պատասխանատվություն:

Բռնազավթված տարածքներում տնտեսական ցանկացած գործունեություն, ներառյալ լիցենզիա, թույլտվություն, գրանցում պահանջող գործունեություն և ցանկացած շինարարություն իրականացվում է Արցախի Հանրապետության օրենսդրությամբ սահմանված կարգով։ Այդ կարգի խախտումն առաջացնում է Արցախի Հանրապետության օրենսդրությամբ սահմանված պատասխանատվություն:

Բռնազավթված տարածքներում Արցախի Հանրապետության օրենսդրության խախտմամբ իրականացված տնտեսական ցանկացած գործունեության արդյունքում ստացված եկամուտները, գույքը և միջոցները, ինչպես նաև շինարարության արդյունքում կառուցված շինությունները հանդիսանում են անօրինական ճանապարհով ստացված և առաջացնում են Արցախի Հանրապետության օրենսդրությամբ սահմանված հետևանքներ:
