ՀՀ քննչական կոմիտեի զինվորական քննչական գլխավոր վարչության հատկապես կարևոր գործերի քննության վարչությունում քննվող քրեական գործի նախաքննությամբ ձեռք բերված ապացույցների բազմակողմանի, լրիվ և օբյեկտիվ հետազոտմամբ, դրանք իրենց համակցության մեջ վերլուծությամբ և համատեղ գնահատմամբ պարզվել է, որ 2020թ. սեպտեմբերի 27-ին Ադրբեջանի Հանրապետության կողմից Արցախի Հանրապետության դեմ սանձազերծված ագրեսիվ պատերազմի ընթացքում, ՀՀ կառավարության թիվ 1586-Ն որոշմամբ հայտարարված ռազմական դրության պայմաններում, ընթացող մարտական գործողություններում ընդգրկվելուց խուսափելու նպատակով, ՊԲ N զորամասերի պարտադիր ժամկետային զինծառայողներ Վ․Կ․-ն ու Ն․Ա․-ն նախնական համաձայնություն են ձեռք բերել միմյանց օժանդակությամբ իրենց առողջությանը վնաս պատճառելու (անդամախեղելու) միջոցով ժամանակավորապես դադարեցնել զինվորական ծառայության առանձին պարտականությունների կատարումը։

Այդ նպատակով 2020 թվականի հոկտեմբերի 19-ին՝ ժամը 02:00-ի սահմաններում, Արցախի Հանրապետության Ստեփանակերտ-Հադրութ ավտոճանապարհի հարևանությամբ Ն.Ա․-ն իրեն ամրակցված ԱԿ-74 տեսակի ինքնաձիգով մեկ կրակոց է արձակել Վ.Կ․-ի ձախ ուսի շրջանին՝ առողջությանը պատճառելով թեթև վնաս, այնուհետև վերջինս իրեն ամրակցված ԱԿ-74 տեսակի ինքնաձիգով մեկ կրակոց է արձակել Ն.Ա․-ի աջ սրունքին՝ առողջությանը պատճառելով ծանր վնաս, որոնք հանգեցրել են նրանց զինվորական ծառայության առանձին պարտականությունների կատարումը ժամանակավորապես դադարեցնելուն:

Վերը նկարագրված հանցավոր արարքները կատարելու համար Վ.Կ․-ին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 363-րդ հոդվածի 5-րդ մասով, 38-363-րդ հոդվածի  5-րդ մասով և 112-րդ հոդվածի 1-ին մասով, իսկ Ն․Ա․-ին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 38-363-րդ հոդվածի 5-րդ մասով, 363-րդ հոդվածի 5-րդ մասով և 117-րդ հոդվածով:

Քրեական գործով նախաքննությունն ավարտվել է, 2022 թվականի փետրվարի 9-ին գործը մեղադրական եզրակացությամբ ուղարկվել է Սյունիքի մարզի առաջին ատյանի ընդհանուր իրավասության դատարան։
