«Փաստ» օրաթերթը գրում է

Հայաստանը 2018 թվականից սկսած առաջ է շարժվում մի ճանապարհով, ըստ որի, իշխանության թևերի միջև հավասարակշռությունը լիովին խախտված է, իսկ փոխզսպման և հակակշռման մեխանիզմները չեն գործում, ինչը հատկապես տեսանելի է դատական իշխանության գործունեության համատեքստում։ Յուրաքանչյուր երկրում, որտեղ գործում է օրենքի գերակայությունն ու անկախ դատական համակարգը, ապա դատարաններն արդարադատությունն իրականացնում են Սահմանադրությանը և օրենքներին համապատասխան։ Սակայն Հայաստանում արդարադատությունն իրականացնելու հարցում օրենքներին ու Սահմանադրությանը սկսել են փոխարինել իշխանությունների կամքն ու կամայականությունը։

Սա մի ուղի է, որի արդյունքում դատական իշխանությունն անմիջականորեն հայտնվում է գործադիր իշխանության կցորդի կամ խամաճիկի դերում։ Դրա համար էլ մի շարք դատավորներ, փաստաբաններ ու իրավաբաններ մեկը մյուսի հետևից ահազանգ են հնչեցնում, թե դատական համակարգի վրա ուղղահայաց բռնաճնշումներ են սկսվել։ Իսկ ավելի կոնկրետ՝ գործադիր իշխանությունը ճնշումներ է գործադրում առանձին դատավորների նկատմամբ ի պաշտոնե դատավորի լիազորությունների ու գործունեության հետ կապված, որպեսզի նրանք ոչ թե անկախ ու օրենքի տառին համապատասխան որոշումներ ընդունեն, այլ կատարեն իշխանությունների սրտի ցանկությունները։ Իշխանությունների ցուցումով նույն գործին է ամբողջությամբ լցվել նաև ԲԴԽ-ն, որը կարգապահական վարույթներ է հարուցում իր թիրախում հայտնված դատավորների նկատմամբ։

Այնպես չէ, որ դատավորների նկատմամբ բռնաճնշումները նոր են, ուղղակի հիմա տպավորություն է, որ համատարած կերպով գործի է դրվում այն պրակտիկան, որ անկախ դատավորներին պետք է հերթով պատժել։ Բայց խնդիրը միայն դատավորներով չի սահմանափակվում, սա կոնկրետ գործընթացների հասունացման արդյունք է և ավելի գլոբալ բնույթ է կրում։ Երբ ժամանակին Արմեն Չարչյանին կամ Սյունիքի համայնքապետներին էին կալանավորում, որի արդյունքում այսօր նույնիսկ երեք պատգամավոր անազատության մեջ է գտնվում, շատ դեպքերում որոշակի շրջանակներ չէին ընկալում խնդրի ամբողջ խորությունը։ Այսինքն, երբ համայնքապետները կամ ընդդիմության ներկայացուցիչները բռնաճնշումների ու հետապնդումների են ենթարկվում, որոշակի շրջանակներ, թեկուզ հասկանալով անօրինականության ողջ ծավալը, նախընտրում էին լռել, քանզի դա իրենց չի առնչվում։ Սակայն ժամանակը ցույց է տալիս, որ այդ «չառնչվելը» ժամանակավոր բնույթ է կրում: Ու եթե դեռ մարդիկ կան, ովքեր մտածում են, թե իրենք հետապնդումների չեն ենթարկվելու, ապա չարաչար սխալվում են։

Բռնաճնշումների հերթը հասնելու է յուրաքանչյուր քաղաքացու՝ ինչ-որ մի պահի բախելով նրանց դուռը։ Ընդ որում, խոսքը ոչ միայն ընդդիմադիր հայացքներ ունեցողների մասին է, այլև թեկուզ ամենափոքր դժգոհություն արտահայտողների: Այսինքն, Նիկոլի Հայաստանում ոչ ոք ապահովագրված չէ, որ «բռնապետիկական» երազանքներ ունեցողի հիմնած տեռորը իր կողքով է անցնելու ու իրեն չի վնասելու։ Ժամանակը ցույց է տալիս, որ գործող իշխանություններից ամեն ինչ սպասելի է, նրանց համար կարևորը իրենց աթոռներն ամուր պահելն է, ուրիշ ոչինչ, ու հանուն դրա նրանք պատրաստ են անցնել յուրաքանչյուր «հպարտ քաղաքացու» վրայով:

Այնպես որ, որևէ մեկը թող «արխային» չլինի, թե նշյալ հարցերն իրեն չեն վերաբերում։ Մի օր անպայման վերաբերելու են: Արդեն որևէ կասկած չկա, որ ժամանակի ընթացքում իշխանությունների ստեղծած ապօրինության ու «բեսպրեդելի» մետաստազներն ավելի են խորանալու և տարածվելու, եթե դրանք կանխելու ուղղությամբ գործողություններ չձեռնարկվեն։ Այնպես որ, դրանք անհրաժեշտ է կանխել որքան հնարավոր է արագ ու կտրուկ, իսկ դրա համար պահանջվում է բոլորի ջանքերի միավորումը։
