Մերձավան համայնքին պատճառվել է շուրջ 8մլն ՀՀ դրամի վնաս. գործը դատարանում է
SOCIETYՀՀ քննչական կոմիտեի Արմավիրի մարզային քննչական վարչությունում իրականացված քննչական և դատավարական այլ մեծածավալ գործողությունների արդյունքում պարզվել են Մերձավան համայնքի ղեկավարի կողմից չարաշահումներ կատարելու դեպքի հանգամանքները, այդ թվում՝ համայնքին պատճառված վնասի չափը:
Քննությամբ ձեռք բերված փաստական տվյալների համաձայն՝ 1996 թվականից Մերձավան համայնքի ղեկավարի պաշտոնը զբաղեցրած անձը, 2007-2008 թվականների ընթացքում, իր ստորագրությամբ հաստատված, համայնքի բնակիչներ չհանդիսացող անձանց տրամադրել է բովանդակությամբ կեղծ քաղվածքներ այն մասին, թե իբր վերջիններիս անունով շրջխորհրդի գործկոմի՝ իրականում գոյություն չունեցող որոշման հիման վրա համայնքում գրանցված են տարբեր չափերի հողամասեր, այդ կերպ համայնքին պատճառելով 8.613.000 ՀՀ դրամ գումարի վնաս և անզգուշությամբ առաջացնելով ծանր հետևանքներ:
Արդյունքում հիշյալ անձինք քաղվածքների հիման վրա, ՀՀ կադաստրի կոմիտեում նշված հողամասերի նկատմամբ գրանցել են իրենց իրավունքներն ու ստացել համապատասխան սեփականության վկայականներ:
Ձեռք բերված բավարար ապացույցների հիման վրա՝ Մերձավան համայնքի ղեկավարին մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 2-րդ մասով և 314-րդ հոդվածի 1-ին մասով:
Կեղծ քաղվածքներն օգտագործած վերոհիշյալ անձինք դիմումներ են ներկայացրել նախաքննական մարմնին այն մասին, որ համաձայն են և չեն առարկում իրենց նկատմամբ վաղեմության ժամկետն անցնելու հիմքով քրեական հետապնդում չիրականացնելուն, բացառությամբ մեկի, ում վարույթն իրականացնող մարմինը մեղադրանք է առաջադրել ՀՀ քրեական օրենսգրքի 325-րդ հոդվածի 1-ին մասով:
Նախաքննությունն ավարտվել է, և քրեական գործը, մեղադրական եզրակացությամբ, ուղարկվել է դատարան:
Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ,քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
