Երևանի ընդհանուր իրավասության դատարանը երեկ մերժեց առանձնապես խոշոր չափերի յուրացման համար մեղադրվող զենքի մատակարար, «Պատրոն Դավո» մականունով Դավիթ Գալստյանին, պաշտպանության նախկին նախարար Դավիթ Տոնոյանին և մյուս բարձրաստիճան զինվորականներին կալանքից ազատելու միջնորդությունը։ Դատարանը նույնիսկ հաշվի չառավ «Քաղաքացիական պայմանագրի» պատգամավորներ Քրիստինե Պողոսյանի, Վիլեն Գաբրիելյանի ու «Հանրապետություն» կուսակցության ղեկավար Արամ Սարգսյանի անձնական երաշխավորությունը, որ նրանք ներկայացրել էին պաշտպանության նախկին նախարարի համար։ Այս գործով փաստաբանները բազմիցս են ներկայացրել նախաքննական մարմնի և իշխանությունների ապօրինությունները, արձանագրել, որ մեղադրանքի կողմը քննության ողջ ընթացքում միջոցներ չի ձեռնարկել հրթիռների անպիտանիությունը ապացուցելու համար, մասնավորապես՝ համապատասխան փորձաքննություն չի կատարվել, իսկ ՀՀ պաշտպանության նախարարությունն առ այսօր հրթիռների որակի հետ կապված որևէ խնդիր չի տեսնում: Ավելին, փաստաբանները պնդում են, որ հրթիռները ժամկետանց և անորակ չեն, ձեռք են բերվել նախորդ գնումից և գրավադրման արժեքից 100 ԱՄՆ դոլարով ավելի էժան, իսկ ՊՆ-ն ունեցել է դրանց խիստ պահանջը:

Փաշինյանական պատգամավորների և իշխանամետ կուսակցութան ղեկավարի անձնական երաշխավորությունը հաշվի չառնելը, վերը նշված փաստերն անուշադրության մատնելը, դատական նիստերը միտումնավոր դռնփակ անցկացնելը հերթական անգամ վկայում են, որ այս գործով պարզ հաշվեհարդար է իրականացվում Դավիթ Գալստյանի, Դավիթ Տոնոյանի և մյուսների նկատմամբ։ Իրավական պետություններում խափանման միջոց կալանքը ոչ թե պատժամիջոց է, այլ միջոց, որպեսզի մեղադրյալները չխուսափեն արդարադատությունից, չխոչընդոտեն քննությունը։

«Պատրոն Դավո»-ն նախկինում մեկ անգամ ևս կալանավորված է եղել, ապա ազատ արձակվել։ Եվ դրանից հետո Գալստյանը որևէ կերպ չի խոչընդոտել նախաքննությանը, չի լքել Հայաստանի տարածքը, որևէ ապօրինություն իրեն թույլ չի տվել, ընդհակառակը, պատրաստակամորեն համագործակցել է քննության հետ։ Եվ կողքից դիտողի համար առնվազն տարակուսելի է, թե ինչու է Նիկոլ Փաշինյանն ու նրա ձեռնասուն արդարադատության համակարգը համառորեն շարունակում կալանքի տակ պահել զենքի գլխավոր մատակարարին, փոխանակ օգտագործի նրա կապերն ու հնարավորությունները հանուն Հայաստանի Հանրապետության։ Փաստն այն է, որ կալանքը կիրառվում է Նիկոլ Փաշինյանի կողմից որպես պատիժ և իր անձնական ամբիցիաների արտահայտում։ Փաշինյանը որևէ կերպ չի կարողանում ո՛չ Դավիթ Գալստյանից, ո՛չ էլ մյուսներից իր համար քավության նոխազ կերտել, և այժմ, նրանց ապօրինաբար պահում է անազատության մեջ, փորձում տպավորություն ստեղծել, թե նրանք են մեղավոր 44-օրյա պատերազմում իր պատճառով կրած պարտության համար։
