Ազգային ժողովի «Քաղաքացիական պայմանագիր» խմբակցության պատգամավոր Հայկ Սարգսյանն առաջարկում է «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» օրենքում փոփոխություն կատարել, որով պարտադիր զինծառայությունից կազատվեն մարտական գործողությունների զոհերի կրտսեր եղբայրները։

«Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» օրենքի 21-րդ հոդվածը սահմանում է պարտադիր զինվորական ծառայությունից ազատվելու հիմքերը, որոնցից է՝ ընտանիքի միակ արու զավակ լինելը և միաժամանակ Հայաստանի Հանրապետության պաշտպանության մարտական գործողությունների կամ զինված ուժերում կամ այլ զորքերում կամ Հայաստանի Հանրապետության միջազգային պայմանագրերով Հայաստանում տեղակայված օտարերկրյա պետությունների զինվորական ստորաբաժանումներում զինվորական ծառայության ընթացքում զոհված (մահացած) ծնող կամ եղբայր կամ քույր ունենալը: Պատգամավորն առաջարկում է օրենքից հանել «ընտանիքի միակ արու զավակն է» բառերը՝ այդ կերպ զինվորական ծառայությունից ազատվելու հնարավորություն տալ զոհված զինծառայողների ընտանիքի անդամներին՝ անկախ այն հանգամանքից՝ նրանք հանդիսանում են ընտանիքի միակ արու զավակը, թե ոչ: Սակայն նախագծում ներկայացված չեն հստակ թվային տվյալներ, թե առաջարկվող փոփոխության շահառու քանի ընտանիք կարող է դառնալ, սակայն նշվում է, որ այս փոփոխությամբ պարտադիր զինծառայությունից ազատվողների թիվը մեծ չի լինելու։

Այս թեմայի մասին զրուցել ենք իրավապաշտպան Ժաննա Ալեքսանյանի հետ։

Հարցին, թե իրավապաշտպանն ինչ կարծիք ունի առաջարկվող փոփոխության մասին` Ժաննա Ալեքսանյանն ասաց․ «Նմանօրինակ կարգ կամ օրենք մենք ունենք, դա Վազգեն Սարգսյանի ժամանակ է ընդունվել, որ զոհվածների եղբայրներին բանակ չեն տանում։ Այլ բան, որ զորակոչի ժամանակ պաշտպանության նախարարությունը կարող էր շրջանցել այդ կարգը և ընտրողական մոտեցում ցուցաբերել։ Կարգը մինչև հիմա էլ գործում է, վերջերս եմ խոսել ՊՆ-ի մարդու իրավունքների կենտրոնի հետ․ զոհված մի տղայի եղբորն ուզում էին զորակոչել, ընտանիքը մեզ էր դիմել ու իմացանք, որ կարգը մինչև հիմա էլ գործում է։ Այնպես որ, Հայկ Սարգսյանը պետք է ծանոթանար կամ խորհրդակցեր մասնագետների հետ ու իմանար՝ ունե՞նք այդպիսի օրենք, թե՞ չունենք»։

Անդրադառնալով այդ օրենքի մասին իր կարծիքին` իրավապաշտպանն ասաց․ « Ես այդ օրենքը դրական եմ համարում, չի կարելի նույն ընտանիքին դնել հարվածի տակ։ 44-օրյա պատերազմից հետո մենք տեսնում ենք, որ կան ընտանիքներ, որոնց երկու զավակներն էլ զոհվել են։ Չպետք է երկու եղբայրներին էլ տանել նույն տեղում ծառայելու, այս հանգամանքը պետք է վերանայել, սրա մասին պետք է մտածի կառավարությունը, որովհետև նմանօրինակ դեպքերը շատ են։ Պետք է այդ ընտանիքների մասին մտածել․ ինչո՞ւ այնպես չեն կարգավորել, որ երկու եղբայրն էլ միևնույն տեղում չլինեին, սա անընդունելի եմ համարում»։
