Արգելվում է գործատուի նախաձեռնությամբ լուծել աշխատանքային պայմանագիրը հղի կանանց հետ

Հղի կանանց և մինչև երեք տարեկան երեխա խնամող աշխատողների իրավունքներն ու երաշխիքները սահմանված են ՀՀ աշխատանքային օրենսգրքով։

Ինչպես տեղեկացնում են ՀՀ աշխատանքի և սոցիալական հարցերի նախարարությունից, ըստ այդմ՝ արգելվում է գործատուի նախաձեռնությամբ լուծել աշխատանքային պայմանագիրը հղի կանանց հետ՝ հղիության մասին գործատուին տեղեկանք ներկայացնելու օրվանից մինչև հղիության և ծննդաբերության արձակուրդի ավարտից հետո մեկ ամիսը լրանալը (բացառությամբ կազմակերպության լուծարման հետևանքով աշխատանքային պայմանագրի լուծման դեպքերի): Արգելվում է նաև հղի կամ մինչև մեկ տարեկան երեխա խնամող կանանց ներգրավել ՀՀ օրենսդրությամբ սահմանված ծանր, վնասակար, առանձնապես ծանր, առանձնապես վնասակար աշխատանքներում։

Աշխատանքային օրենսգրքի համաձայն՝ աշխատող կանանց տրամադրվում է հղիության և ծննդաբերության արձակուրդ՝

1) 140 օր (70 օր` հղիության, 70 օր` ծննդաբերության ժամանակահատված),

2) 155 օր (70 օր` հղիության, 85 օր` ծննդաբերության)` բարդ ծննդաբերության դեպքում,

3) 180 օր (70 օր` հղիության, 110 օր` ծննդաբերության)` միաժամանակ մեկից ավելի երեխաներ ունենալու դեպքում։

Երեխային փաստացի խնամող ընտանիքի մոր, հոր կամ խնամակալի ցանկությամբ տրամադրվում է երեխայի խնամքի արձակուրդ՝ մինչև երեխայի երեք տարեկան դառնալը։

Աշխատողի խնդրանքով՝ կանանց հղիության ու ծննդաբերության արձակուրդից առաջ կամ հետո, տրամադրվում է ամենամյա արձակուրդ մինչև անընդմեջ աշխատանքի վեց ամիսը լրանալը, իսկ հղի կանայք և մինչև 14 տարեկան երեխա խնամող աշխատողներին ամենամյա արձակուրդի ժամանակի ընտրության իրավունք է տրվում՝ անընդմեջ աշխատանքի վեց ամիսը լրանալուց հետո։

Աշխատանքային օրենգրքով հստակեցված են նաև հղի կանանց և մինչև երեք տարեկան երեխա խնամող աշխատողների՝ աշխատանքային գործընթացում ներգրավման պայմանները։ Ըստ այդմ՝ հղի կնոջ և մինչև մեկ տարեկան երեխա խնամող աշխատողների պահանջով կարող է սահմանվել ոչ լրիվ աշխատանքային օր կամ շաբաթ։ Այս դեպքում աշխատանքը վարձատրվում է փաստացի աշխատած ժամանակին կամ կատարված փաստացի աշխատանքին համապատասխան։

Հղի կանայք և մինչև մեկ տարեկան երեխա խնամող աշխատողները միայն իրենց համաձայնությամբ կարող են ներգրավվել և մասնակցել՝

արտաժամյա աշխատանքի,
հանգստյան օրերին աշխատանքի,
տանը կամ կազմակերպությունում հերթապահության (հղի կանանց և մինչև երեք տարեկան երեխա խնամող աշխատողների դեպքում),
ոչ աշխատանքային` տոնական և հիշատակի օրերին աշխատանքի,
մեկնել գործուղման։
Երեխային կրծքով կերակրող կնոջը մինչև երեխայի մեկուկես տարին լրանալը, բացի հանգստի և սնվելու համար տրամադրվող ընդմիջման ժամերից, յուրաքանչյուր երեք ժամը մեկ տրամադրվում է լրացուցիչ ընդմիջում երեխային կերակրելու համար` կես ժամից ոչ պակաս տևողությամբ: Այդ ընդմիջումների ժամանակահատվածում աշխատողը վարձատրվում է միջին ժամային աշխատավարձի չափով:
