«Լավ որոշում չէր». ՄԻՊ-ի թեկնածուն` դատարանները շրջափակելու Փաշինյանի կոչի մասին
POLITICS«Հայաստան» խմբակցության պատգամավորն Արամ Վարդևանյանը «Քաղաքացիական պայմանագիր» խմբակցության կողմից առաջադրված Մարդու իրավունքների պաշտպանի թեկնածու Քրիստինե Գրիգորյանի հետ հանդիպմանը նրան հարց ուղղեց․
Ձեր խոսքում ասացիք, որ դատավորներին գործերն էլեկտրոնային համակարգով մակագրումն արդար դատաքննության, դատավորների անկողմնակալության ստանդարտ է։ Այդ ստանդարտը չկա 2021 թվականի հուլիսից։ Ձեր գնահատականը դրան որպես ՄԻՊ թեկնածու՝ արդար դատաքննության իրավունքի, օրենքի հիման վրա ստեղծված դատարանի կոնցեպտի տեսանկյունից ո՞րն է։
Ի պատասխան` Գրիգորյանը նշեց․ «Բնականաբար, խախտված է այդ իրավունքը, պետք է այդ իրավունքը վերականգնվի։ Ձեր ասած այդ գնահատականից կարող եմ հետևություն անել, որ եթե այդ ստանդարտը խախտում է, խախտում կա 2021 թվականի հուլիսից բոլոր գործերով և այդ բոլոր գործերով ունենք արդար դատաքննության իրավունքի խնդիր։
Գործնականում ես ասացի, որ խախտված է այդ իրավունքը, որովհետև եթե չունենք այդ անկողմանակալ, պատահական մակագրման համակարգը, դրա բացակայության պայմաններում նաև եթե ապահովված չեն օբյեկտիվ անկողմնակալ սկզբունքները, այսինքն՝ եթե դա չկա, այլ միջոցներով պետք է երաշխավորել այդ մակագրումները, որ լինի անկողմնակալ։ Եթե այդ բոլորը չկան, նոր պետք է արձանագրել խախտում»։
Գրիգորյանի խոսքով` արդար դատաքննության իրավունքի խախտում արձանագրելու համար պետք է նաև պատասխանել այս հարցին՝ արդյո՞ք այլ օբյեկտիվ սկզբունքներով մակագրում առկա է, թե ոչ.
«Եթե այդ հարցին պատասխանեցինք ու ասացինք՝ ոչ, նոր կարող ենք արձանագրել իրավունքի խախտում։ Որտեղ որ փաստեր ունենք, որ նման սկզբունքով չի մակագրվել, այո, կան խախտումներ։ էլեկտրոնային մակագրման համակարգի չվերականգնումը խնդիր է, բայց խախտումն արձանագրելու համար պետք է նաև փաստեր ունենալ, որ ալտերնատիվ տարբերակն էլ չի գործել»,- ասաց նա։
Վարդևանյանը հետաքրքրվեց՝ Գրիգորյանն անդարադարձ կկատարի՞ 2019 թվականին վարչապետ Նիկոլ Փաշինյանի՝ դատարանների մուտքերն ու ելքերը շրջափակելու վերաբերյալ կոչին։
«Որևէ խնդիր չեմ տեսնում դրան անդրադարձ կատարելու, հատկապես, երբ դրանք ՄԻՊ-ի զեկույցում էլ են արտացոլվել», - արձագանքեց Քրիստիննե Գրիգորյանը։
Վարդևանյանը հետաքրքրվեց՝ որպես ՄԻՊ-ի թեկնածու՝ ինչպիսի՞ն է դիրքորոշումը Նիկոլ Փաշինյանի այդ կոչին, Քրիստիննե Գրիգորյանն էլ պատասխանեց. «Դե, բնականաբար, չեմ համարում, որ լավ որոշում էր. լավ որոշում չէր»։
