Առողջապահության նախարարի հերթական խայտառակ որոշումը հրապարակվեց:

Առաջին տպավորությունն այն է, որ Անահիտ Ավանեսյանի մոտ սեփական լիազորությունների ընկալման գերդոզավորում է, որն ուղեկցվում է քաղաքացիների կամ անձանց իրավունքների կոպտագույն ոտնահարումներով:

Ըստ այդմ, ՀՀ ԱՆ նոր որոշման համաձայն` սրճարաններ, թատրոններ, մարզասրահներ, գրադարաններ, հյուրանոցներ և ժամանցի այլ վայրեր այցելելիս անձինք պետք է ներկայացնեն պատվաստման սերտիֆիկատ կամ ՊՇՌ բացասական արդյունքով 72 ժամ վաղեմության թեստ կամ հակամարմինների առկայության մասին 24 ժամ վաղեմության տեղեկանք:

Եվրոպայի խորհրդի Խորհրդարանական վեհաժողովի՝ 2021 թվականի հունվարի 27-ի «Covid-19 պատվաստանյութեր. էթիկական, իրավական եւ գործնական նկատառումներ» վերտառությամբ թիվ 2361 (2021) բանաձեւում, մասնավորապես, նշված է, որ Եվրոպայի խորհրդի անդամ պետությունների կառավարությունները պետք է ապահովեն, որ սեփական երկրի քաղաքացիները տեղեկացված լինեն, որ պատվաստումը պարտադիր չէ, եւ որեւէ մեկը չի կարող ենթարկվել քաղաքական, սոցիալական կամ այլ ճնշման՝ պատվաստվելու համար, եթե նրանք չեն ցան- կանում պատվաստվել: Պետությունների կառավարությունները պետք է ապա- հովեն, որ ոչ ոք խտրականության չենթարկվի պատվաստված չլինելու համար՝ առողջական հնարավոր ռիսկերի կամ պատվաստվել չցանկանալու պատճառով (7.3.1, 7.3.2-րդ ենթակետեր):

Եվրոպայի խորհրդի Խորհրդարանական վեհաժողովի՝ 2021 թվականի հունիսի 22-ի՝ «Covid-ի անցագրեր կամ վկայագրեր. հիմնարար իրավունքների պաշտպանություն եւ իրավական հետեւանքներ» վերտառությամբ թիվ 2383 (2021) բանաձեւում, մասնավորապես, նշված է, որ եթե պատվաստվելուց հրաժարվելու հետեւանքներն այնքան ծանր են, ներառյալ՝ ազատություններից օգտվելու սահ- մանափակումները, որ բացառվում է ընտրության հնարավորությունը, դա կարող է համարժեք լինել պարտադիր պատվաստմանը (10-րդ կետ, նաեւ 13.3.8-րդ ենթակետ):

ՀՀ ՍԴ-ն իր ՍԴՈ – 1621 որոշմամբ արտահայտած իրավական դիրքորոշումների տրամաբանության հիմքում դրել է այն ելակետը, որ սահմանված պարտավորությունները չպիտի անուղղակի միջամտել անձի` սահմանադրությամբ երաշխավորված սեփականության իրավունքին:

Սա և ՍԴ վերոնշյալ որոշման մեջ առկա մի շարք շեշտադրումներ կանխատեսելի ուղենիշեր են ԱՆ համար, որոշումից հետո համապատասխան հրամաններ արձակելիս հաշվի առնել արտահայտված իրավական դիրքորոշումները, բայց այնքանով, որքանով ՊՇՌ թեստավորումների մասով ՍԴ որոշումը ԱՆ համարել էր հաղթանակ, արդյունքում ունենք այնքանով որքանով նոր հակաիրավակ հրաման:
