Նոյեմբերի 16-ին մարտական հերթապահություն իրականացրած պատասխանատու զինծառայողները կալանավորվել են․ ՔԿ
SOCIETYՀՀ քննչական կոմիտեի զինվորական քննչական գլխավոր վարչության հատկապես կարևոր գործերի քննության վարչությունում շարունակվում է 2021 թվականի նոյեմբերի 16-ին Ադրբեջանի զինված ուժերի կողմից Սյունիքի մարզի Կիլիսալի-բնագիծ Իշխանասար հատվածում տեղակայված թվով 3 յուրային մարտական դիրքերի ուղղությամբ ագրեսիայի ակտ իրականացնելու, միջազգային մարդասիրական իրավունքի նորմերի լուրջ խախտումներ համարվող արարքներ կատարելու, ինչպես նաև՝ մարտական հերթապահություն կամ մարտական ծառայություն կրելու կանոնները խախտելու փաստերի առթիվ հարուցված քրեական գործի նախաքննությունը, որի շրջանակներում երկու մարտական դիրքերի ավագներին և երկու դիտորդներին մեղադրանք էր առաջադրվել ՀՀ քրեական օրենսգրքի 365-րդ հոդվածի 3-րդ մասի հատկանիշներով, նրանց նկատմամբ որպես խափանման միջոց կիրառված է կալանավորումը։
Քրեական վարույթի շրջանակներում իրականացված մեծածավալ քննչական և այլ դատավարական գործողությունների արդյունքում ձեռք բերված փաստական տվյալների հիման վրա պարզվել է, որ կապիտան Ա.Խ.-ն, զբաղեցնելով ՀՀ ՊՆ N զորամասի վաշտի հրամանատարի պաշտոնը, որպես երկու դիրքերի՝ հենակետի պատասխանատու, ընդգրկված լինելով մարտական հերթապահությունում, խախտել է «Հայաստանի Հանրապետության զինված ուժերի ներքին ծառայության կանոնագիրքը հաստատելու մասին» ՀՀ օրենքի, ՀՀ պաշտպանության նախարարի N հրամանով հաստատված մարտական հերթապահության կազմակերպման և իրականացման կանոնադրության, ՀՀ ԶՈՒ մարտական կանոնադրության դրույթները, որպիսի գործողություններն առաջացրել են ծանր հետևանքներ. մարտական դիրքերն անցել են հակառակորդի վերահսկողության տակ, դիրքերում հերթապահություն իրականցնող զինծառայողները հակառակորդի կողմից շրջափակվել և գերեվարվել են, որոնցից Գուրգեն Աշոտի Սարգսյանի և Դավիթ Հելբերտի Ամիրյանի սպանված դիերը համապատասխանաբար 2021թ. նոյեմբերի 17-ին և 20-ին փոխանցվել է հայկական կողմին, 10 զինծառայողներ գերությունից վերադարձվել են, իսկ 2 զինծառայողներ, համաձայն քննությամբ ձեռք բերված տվյալների, Ադրբեջանում շարունակում են պահվել գերությունում։
2021 թվականի դեկտեմբերի 29-ին կապիտան Ա.Խ.-ն, ի թիվս այլ զինծառայողների, վերադարձվել է ՀՀ։ Վերջինիս մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 365-րդ հոդվածի 3-րդ մասի հատկանիշներով և որպես խափանման միջոց կիրառվել կալանավորումը։
